and that v&a the only judgment rendered by
tbo oonrt in the case, to which judgment (be
plaintiff excepted. The dismissal of the plain
tiff's levy on Ibe property of the defendant,
Lecause there was no affidavit of the payment
of taxes aa required by tbe art of 1870, was an
error. It would nociu, according to the pro
visions of tbe 32C4lb section of too Code, that
in Older to traverse the entry of service by the
sheriff that the defendant thould show that he
baa done no at the first term after notice cf
such entry is had by him, or abould ahow that
ho had no notice of the pondeney of the suit
against him prior to the rendition of the judg
ment.

due one day after date, for 9425,000, the other
note dated 28ih March, 1SC1, for $25, end ob
tained a judgment for tho tall amount due on
the note, ou tho 14th September, 1807. In
March 1873, motion waa made to opan and re-
duco that judgment nnder the provisions of Ibe
Itellef Act of 1868. Oo tho bearing of that
tuclion tho jary, under tbo charge of tbe oonrt,
found a verdiot for tba plaintiffs for tho foil
amount of judgment. The defendants made a
motion fora new'trial on tbo ground that tbe
court erred in lla charge to tho jnry, which waa
ovemied, and tho defendants excepted. The
court obargrd the Jury in substance, that the
tender,-or offer to tender. Confederate notea in
payment of the plaintiff ’ajdebtor, tho offer to
do tbo other thiags as set forth in the rocord,
did not create snob an equity aa would tulhor-
Ixo tho Jury to reduoo amount of the judgment.
In view of tho evidence contained in too reeord,
we find no error in tbe charge of tho court to
the jury, orintho refusal to grant a new trial.

Waumui, 0. .1.—This was a claim Cano sub
mitted to tbo Court below to determine the law
aud the facta without the intervention of a
jury. Tho Court deoided In favor of the claim,
whereopon tbe plaintiff excepted. It appears
from the evidenoe In record that Howard, on
tbo lhth day of January, 1872, purchased a
■lock of goods of Anderson, and executed a
mortgage to him on the goods to secure tho pay.
ment therefor. In the month of February,
1872, Sima .V Howard lonued a co-partnership,
the terms of which were that Sims was to fur
nish goods equal in value to thoee put in by
Howard, and to aharo equally in theprofltK.
Subsequently goods were purchased by the firm
and addod to the stook purchased by Howard
from Anderson aa needed according to the
agreement cf tho parties, whieh goods wero
purchased in the name of Howard A Sims, and
shipped to them and paid for by them, except
tbe amonnt of $420, which remains nnpaid.
On the 18th of May, 1872, Anderson foreclosed
bin mortgage on the goedt aolil to Howard, and
an execution waa levied by the sheriff on all
the goods found in tho store boose on the 25th
of May. 1872. On the lat of June, 1872, How
ard A Sims interposed tlieir claim for certain
specified artioles of the goods levied on
aa tbe property of Howard, alleging
that said * specified goods were not
the property of Howard, hut wero the property
of the copartnership. The goods claimed art>
goods pnrohaaed by tho copartnership Him, hut
tbe goods in the store were sold by the partner!
Indiscriminately aa well from the stock pur
chased by Howard from Anderson, as from the
additional stock pnrohaaed by the oorpartner-
sbip firm, and tho question is, whether the ad.

nership is liable to be sold to an amount equal
to that of tho goods sold by Howard, covered

goods or other things in hulk, but changing

tt is undoubtedly true that if Howard, tbe mort
gagor, had disposed of s part of the goods
covered by his mortgage to Anderson, ami had
pnrohaaed and paid for other goedi to supply
thq place of those disposed of, that the mort
gage lien would attaoh to tho goods so pur-
obaaed to the extent only of tho value of the
otlgiual stock mortgaged. Chisholm vs. Chit
tenden, 43lh Georgia Reports, 213. But in tbe
oaae now before the oonrt, the additional atock
of goods lovied on waa not pnrohaaed by How
ard, the mortgagor, but waa purchased by How
ard A Sims, a different unit distinct party in
contemplation of the law, who have never exe
cuted a mortgage npon 8Dy goods, so' far as the
reoord shows, and we cannot suppose that it
waa intended by this section of the Code fo cre
ate a lien npon goods purchased by third per-
eons, who were no parties to the mortgage. The
goods covered by the mortgage were the indi
vidual property of Howard, tho mortgagor, the
the goods claimed are tbe property of Howard
A Sima, a different and distinct party in con
templation of tho law. The Court passed its
judgment npon the facts as well as the la#, in
cluding the question of frand, and is to Lo con
sidered in the light of a verdiot of the jury.
