here on his second trial in the
heinous combination pistol and
hatchet murders of hi s wife, baby

Haymond Carver was freed today.
The former real estate dealer es
Philadelphia and Miami was ch tir
ed after an earlier conviction and
a serving of the life sentence
In the trying of the case which
dates back to early in 1930 at the
Carver home near Seabring the
jury deliberated but 1 hour and 5
minutes. He was immediately con
victed, being at first, refused a re
hearing before the Superior Court,
but later, a request by the defense
for a re-trial was favored.
The state charged that Carver
killed his wife and son to collect I
the insurance money on Mrs. Car
ver’s life. Quite as vindictively, it
was claimed that he shot his Negro
servant in an effort to allay the
blame to him Carver’s conten
tion was that he killed the servant
after the latter had •'croaked" his
wife and son. AIT the evidence, j
however, was circumstantial.
Grady Burton, attorney for the
state, was rigid in his claim that
“Carver is guilty of murder in the
first degree or h? is not guilty of
any .rime." He told the jury so.
This drew the following bit of
ridicule from W. D. Bell, chief de
fense counsel: “You could have
made a better case against Colon
.cj ’Lindberg^ for kidnaping Ips
baby than the state made out u
gainst William Raymond Carver."
Burton steadfastly told the jury'
that Carver “premeditated this,
dastardly deed, killing his wife to

admitted that he had been in ide

years and was not entitled to prose
cute the suit under the pauper |
clause, United States Judge
Wayne G. Borah sustained motion j
of the government dismissal of the ■
suit when testimony wa- introduced
to show that Rosser was not a
pauper and that since 19'26 he had
been employed te unload bananas
from the United Fruit company
boats.

plucking facts and putting them to
gether into a mosaic in the center
of which was Carver, caused his
defeat, and. after the hour and five
minute deliberation. Carver and

Carver and Julius Stapf. walked
out of the courtroom, the former a
free man. Carver said he would go
to Miami to spend the winter with
relatives.

(ANPi—The Poplar Grove giaded
school, which was erected about
seven years ago through the phil
anthropy of the late Julius Ros.n
wald. was destroyed by fire here
late Tuesday night.
The gfire is thought to have had
its origin in a defective flu and
was not discovered until the flam
es had got quite a headway. By
the time the firemen arrived the
fire had gutted the building but
fortunately the damage was cover
ed by insurance. therefore the
building will be put in shape im
mediately.
The building wa s one of the most
attractive school buildings in this
section, being of brick construction
and housing eight class-rooms, an
auditorium and a library, and its
loss will prove a distinct advantage
to hundreds of pupils who attend
ed the school daily.

both financed by the city of Balti
more. made their debut here last
Thursday before an audience of
2.500 persons. This is the first
Municipal Colored Bend in the
