W HEREAS In and by an V V aft, puffed the nth day of May 1803, entitled, “ An Ad to make diftribudon of the iite ceffion of lands obtained from the Creek Nation, by the United States Commifficners, in a treaty entered into, at or near Fort Wilkinfon, on the fixteenth day of June 1802,” the Gover nor is authorized and required forthwith, to idlie his proclama tion, and caufe the fame to be jpubMhed in ail the Gazettes of this date, letting forth the out lines of the aft, and requiring all perfons interefted therein, to exhibit their claims in the coun ties of their refpeftivc refidence, fupported by the oath or affir mation of one or more credita ble witnefles, where doubts ex ill in the minds of the Juftices of the Inferior Courts, or the perfons by them appointed to receive the fame. I have there fore thought fit to iffue this my proclamation, in order to make known the out-lines of the fakl aft, which are as follows: The Territory to which the Indian title has been extin guifhed by the faid treaty of Fort Wilkinfon, and for the diftribudon of which, the afore - recited ad has been palled, is in conformity to the twenty third fedion of the firft article of the conftitution of this Rate, to be laid off into three counties, • that is to fay, that part of the faid territory lying fouth of the Alatamaha, to form and confi ture one county, to be called Wayne, and that part of the faid territory lying fouth of the Oconee River, to be divided in to two counties, the eaftern to be called Wilkinfon, and the weftc rn Baldwin j the County of Wayne is to be divided into three diftrids, as nearly equal ?s circumftanccs will admit, in inch manner as the Surveyor- General may deem mod expe dient; and the Counties of Wilkinfon, and Baldwin, into five diftrids each, as nearly cqDal in extent as can be. The land contained in the feveral diftrids is to be divided, by lines plainly and diftindly marked, into trads of forty-five chahr fc arc, containing two hunched two and an halt acres each—except in the County of vVcyne, where the land is cobs laid off into trads of feventy chains fqtiare, to contain four hundred and ninety acres each— unlefs where the line which is to form a temporary boundary between the faid territory and Creek Indians, or the courfe of navigable rivers, may render it ■mpradicablc, then this rule :be departed from; but no h ther than fuck particular dr c ; rmb, ‘ 3 may require.—All fnftional-parts of furveys, and all i'lands within the limits of ja.d territory, fouth-weft: of the middle of the Oconee or Alata maha Rivers, are to be reserved and fold, giving io mole who draw tracts ci land adjoining fuch fractional parts of iurveys or iflands, refpeftively, a prefe rence for twelve months, front and after the completion efthe drawing of the lottery contem plated by the aft, and a right to purchafe them at Rich rates as may be dipulated by law—ex cept where iOands contain more than one hundred acres-—then they are to be drawn for, in the manner pointed out by the aft. The furveyors are to com mence making the furveys of the didrifts to which they are ref peftively appointed, in their own proper perfons, immediate ly after the boundary line has been run by the proper authori ty- The land is to be diftributed by lottery, (the drawingof which is to commence after the furveying is completed,) in which every free male white perfon, twenty-one years cf age and upwards, who is a citizen of the United States, and who has been an inhabitant of this (lace twelvemonths immediately pre ceding the paflage of the a6l, or paid a tax towards the Tup- j port of government, (including | lurh as may be abfent on law- , ful buhnefs) is entitled to one , draw. Every free male white perfon of the like de feription, having a wife, le gitimate child or children, under twenty-one years of age, to two draws. All widows having legitimate child or children, under twenty-one years of age, who have redded twelve months in this (late im mediately preceding the paf fage of the aft, are entitled to two draws. And all families of orphans, under twenty-one years of age, to one draw. Lids of perfons entitled to draw, are to be made out with in three months from the palfage of the aft, by any three or more of the Indices of the Inferior Courts of the refpeftivc coun ties, or fuch perfons as they nay appoint, not exceeding one for each county, who (hall, be fore they enter on the dudes of their appointments, feverally give bond and ft rarity, to be .approved of by the laid juftices, in fuch fum as they may deem necdTary, and take and fubferibe an oath in writing, to perform the duties required of them by the faid aft. The faid J udices, or fuch perfons as they may ap point, are to attend at the court houfes of the refpeftivc counties, on as many fevcral days as the Judices may think necefTary, to appoint, for the purpofe of taking and nuking out fuch lids, giving at lead ten days notice of fuch attendance, ■ byadvertifement at five or more ■ o. the moil public places in the refpeftivc counties. The names 1 of the perfons entitled to draw 7 , v/itn tne number of draws to which they may be entitled, are to be entered in a book, to be 1 provided for that purpole in each county, which lids or 1 books, when completed, and i tramcripts rhereof depofited in the Clerk’s Odices cf the Supe rior Courts, are to be tranfrnit ted by the faid Juftices to the Governor, for which Ter vice the or Inch perfons as they frisy appoint as afore laid, are to receive from the perfons enti tled to draw, on entering their names refpelively* for each draw, twelve and an halt cents. After the receipt of the re turns from the diftrift furvey ors and Juftices of the Inferior Courts, the Governor is to caufe fair lifts to be made of the perfons entitled to draw, and the lottery carried into effeft, under the fuperintendancy of five ma nagers, or a majority of them, who are to give one month's public notice in all the Gazettes of the ftate, previous to the commencement of the drawing, and make known the days of drawing for the names enrolled under the letter A. for thofe un der the letter B. and fo cn throughout the alphabet, com mencing with the names under the hi ft letter. Perfons who draw lands, are to pay into the treafury of the ftare, within three months im mediately after che drawing is completed, fur the particai liir vey or furveys drawn agamft their names, refpeftively, as fol i lows:— The fum of nine dollars per hundred acres, for river land of the firft: quality—(even i dollars per hundred acres for ri : ver land of the fecond quality i— feven dollars per hundred acres for high land of the firft quali ty —four dollars per hundred acres for high land of the fecond quality i —two dollars per hun dred acres for all third quality land ; and half a dollar per hundred acres for ail pine land. Prices are to be affixed to find lands, in the following man ner, to wit:—All river land of the firft quality, at one dollar per acre—all river land of the fecond quality, at fifty cents per acre—all upland of the firft quality, at fifty cents per acre— all upland of the fecond quality, twenty-five cents per acre—ail upland of the third quality, at twelve and an half cents per acre—and all pine land, at fix and a quarter cents per acre; which fhall be paid by the for tunate drawers, in the following inftallments, to wit:—one third of the price of the refpedive tra£ls, on or before the expira tion of direc years, to be com puted from the firft payment — and one third annually thereaf ter, until the whole price of the land is difeharged, before they receive grants for the lame. And in cafe of failure in any of the afore laid payments, the laid lands (hall revert to, and be vefl ed in the ftate ; but the laid drawers may pay up the whole amount at any time previous to the expiration of 5 years,and receive grants immediately on fo doing. No contract for the convey ance and fale of tickets in the lottery, previous to obtaining grams therefor, is to be obliga tory on cither of the contracting parties, their heirs, executors, adminiftracors, affigns, or devi lees, in any court of law or equity in this ftate. Vacancies of any of the dif tridl furveyors, happening by death, rcfignation, or otherwile, i to be filled by the Governor.
