The defence set up by the defend

purport :
it appears that nn Pnnd.v, the
10di of August, 1800, Mr. Claudius
married Frederica U.illeokamp, at
Lippstadt, in We»tphuji'a, Germany ;
and that he received on the succeed

ducats id II illuinl, being together id
the value of the 80495 36, money of
the Stales ; this amount in be for the
sole and unlimited use of Mrs. CIs-

lion, that neither the above monies,
nor the real or personal property
which Mr. Claudius should heir Irttm
his mother, should he disposed of in
anv manner except according to Jhe
Will soil the unlimited and only pro
per disposal of Mrs. Cladios, or her
lawful heirs. This agreement was
executed in a formal manner in lit
presence of his mother and Susanna
Ualleokamp, the mother nf Mrs. Cla

a judgment bond to Mr. Deck 011 the
3d of August, 1815, puyutde in 18
months which was entered un die re
cord on the 14th of August of the
same year. Mr. Claudius was at that
time, nod is now, in possession of the
property referred to, which with its
original costs and emhelli-liments hy
Mr. Claudius, is estimated at lG OOO
dollars.
Messrs Reed, Hutchinson and
Church, had regularly conveyed the
property to Mr. Claudius. A id as a
security lur the payment of a debt
exceeding 812 000 Mr. and Mrs.
Claudiu-, in November and Decern
her, 1814, transferred the property try
a regular rlreil to Faust Sweudler on
the express condition that it should be
re-tran-ferred, when tire debt was
paid. It appeared that all this debt
was afterwards paid, except 82270,
which Sweudler relinquished in f,rvny
of Mis. Claudius; and that Swendl-r

notpinvirl, nor contended in court,
that Mr. Claudius had set apart the
amount of money referred to in the
marriage settlement ; nos referred to
in any of his transactions, until this
deed to Janes in trust, for Mrs.
Claudius. But it was contended that
Mr; Claudius, by his own books, was
a bankrupt to the amount of 83,590,
on the first of January, 1811,—that in
1816,110 was a bankrupt to the amount
ot 8130,000 and 870,000 iu debt when
he wound up his concern, that he had
