John Curnochun ami Peter Mitchell

mortgaged and assigned to divers persons
eithfcr their individual creditors, creditora
of the late firm of Carnbchan W Mitchell,
or others, all or sundry the property and
rstnte, both real and personal, of the said
firm, as well as their own individual pro**
perty ond estate,’coiwtisting together of
'loitaei, lots, lands, at urea, wharves, negroes,
Ac. in Savannah and l)a>ien in Georgia, or
tho neighbmhood thereof, and elsewhere
with thuir Interest or share in the stock
of the lower steam mill near Darien, and
sundry shares in Hie Uiiited Stales Rank
and other banka, as well uo sundry debts
due to them in various places, besides
lands, lots, neferoea, &c. in the territory ol
Florida, and particularly one forgo tract of
land bought of Forbes M Co. lying be
tween the rivers 8t. Marks and Apalachi
cola in the territory of'Florida aforesaid.

who lias undoubtedly claims against them,
which, when finally liquidated on the 1 de
cision of the suit now pending, they will
try to jatisfy as soon as possible thereafter.
The needs under which Mr Chrisliccluims
an exclusive right to all the real and per
sonal estate of Cnvnochan & ‘Mitchel, arc
considered os informal, unjust and illegal,
Hence they have been brought and arc still
before the court, and other deeds have
been executed and recorded, conveying
the property fbr the use of all thtir credit,
ors, Mr Christie included, without any trust
or reservation beneficial to*iC. WM. or their
families! and if this be not agreeable to that
J fentleman, it must neverthelfess appear
iiir and equitable to the public and all who
have a tense of justice.
The Trustees under the lute deeds are
•nxious to sell the Lauds in Florida, alluded
to in the notice of Mr Christie, and to ap.
ply the proceeds to the immediate payment
of part of his demand, and deposit a suffi
ciency thereof to cover all hia claim, sub
ject to the decision of the court-—but his
opposition to any reasonable sale, as one in
terested in his own right, whilst injuring
all parties concerned, must be borne until a
sale can be made under an order of court,
