And your petitioner saitli, that although said promis
sory note haslong since been due, yet the said George
H. Sims has not paid the same, or any pert thereof.
Wherefore, it is on motion, ordered, that unless the
said George H. Sims do pay into the clerk’s office of
this court, the principle and interest due on said
promissory note together x^ilh the costof this applica
tion, within six months from the date of this applica
tion, or shew sufficient cause to the contrary: that tbe
equity of redemption in' and to the said mortgaged
C remises, be then and from thcncc forward, forever
arred and foreclosed. And it is further ordered,
llmt a copy of this rule be published in'one of the
public gazettes of this State, once a month for four
months, orservedon the said George il. Sims in per-

T HE petition of John Ruwls shews to tho Court
tha l’inkney Yarbrough, while in life, ica^
his liond, a copy of which is annexed, to Tuttle II.
Moreland, with Uriah Yarbrough in the sum of two
hundred dollars, conditioned that the said Pinkney
lias to make good and lawful titles to lot number ninc-
ty-thrde in the thirteenth district of said county, and
tiie said bond dated 9th January, 1622, and that on
the 30th May, 1822, the suid Tuttle IL Moreland as
signed said bond to your petitioner John Raxvls,’and
that the said Pinkney has since departed this lifq/and
that William Byrd has administered on laid Pinknc/
Yarbrough's estate, and that said titles have never
been made and executed. On motion of Arthur A.
Morgan attorney of the said John Raxvls,
Ordered, That ihe said William Byrd shexv cause
