The supreme court yesterday affirmed

cusLu. A telegram to that effect was re
ceived br Judge Eallijrant, and the solicitor

of solicitors general were u>t expe.is of
the c nirt under the coustitu ion of Georgia,
and that counties cannot be taxed to pay
them in that case.
In the decisions affirmed yesterdav Judge
Falligant neld that the cas-s are different
from the cose of Glenn & Ellis, and that
th" custom of the circuit and the act under
which the costs were collectable made them
ex | earns of court within the purview of
H, institution. In the case of Wright,
lirito - , the act of 1873, which anted ited
the constitution of 1577, provides that tue
s dicitor general at each term of court could
present liis bill of insolvent costs to the
prarii jury of the county, and if the grand
jury approved it the court snould
grant an order on the treasurer
lor payment. That had been the
custom of the Augusta circuit from 1873
up to the judgment of the supreme c ;urt iu
the Glenn & Ellis case, Adams, the treas
urer of Richmond county, after the rendi
tion of the Glean & Ellis case, refused to
pi*v Wright’s insolvent costs under the
in Igfc’s order. Mandamus proceedings
’were instituted by Wright to compel the
payment, and Judge Falligant made the
mandamus absolute, and the treasurer ap
pealed.
In the case of C. Henry Cohen, solicitor
of the city court of Richmond county, the
eel establishing this court was passed aft r
the aloption of the constitution of 1877.
The act provided in like manner that all
bills for insolvent costs that may become
due the solicitor when examined and ap
proved by the judge of the court, shall be
paid by the treasurer of the countv out of
any funds in the treasury. Judge Falligant
held in this case that that provision being in
the act establishing the city court, which the
legislature bad the right t > do under its
constitutional power, made the insolvent
c sts of the solicitor general expenses of
that court, and that he was entitled to bo
paid by the treasurer. He therefore made
the mandamus absolute iu the Cohen.case,
ami an appeal was taken as in the former
case.
The effect of this decision will be to pre
serve the present custom of paying in
solvent costs here under the special act by
which the insolvent costs are divided pro
rata between the solicitor general and the
sheriffs and clerks of the respective courts
in this county.
It is understood that in Augusta the
three court officers, solicitor general, sheriff
ami clerks, have been drawing from the
treasury all that is due from insolvent
o .-is. and as this was a corsiaerabla amount
it was sought to break up the cus
tom. In this county only such costs
ns are collected and the fines for
misdemeanors go to pay the insolvent
Ci ists, hieh are a small part of the insolvent
Co-. It is likely that with the decision of
the supieme court yesterday confronting
them with the people of Augusta will have
to get a special act something tike that gov
erning insolvent costs iu this county and
circuit.

hn with 2,375 barrels of rosin weighing
