FREDERICK W BOUND, complainant, vs. the
SOUTH CAROLINA RAILWAY COMPANY et
al., defendants, in equity. It appearing to the
court that the above stated suit was commenced
to enforce a hen upon the real and personal
property of the South Carolina Railway Com
pany within this district, and that the defend
ants, Samuel Sloan and John S. Barnes of the
city of New York, trustees of the first consoli
dated mortgage on the South Carolina Railway
Company, and Johns 8. Barnes and Jamos J.
Higginson of the city of New York, trustees
under the second consolidated mortgage on the
South Carolina Railway Company. James J.
Higginson and Francis A. Stout of the city of
New York, trustees under the income mortgage
of the South Carolina Railway Company, and
James M. Colder of Liverpoolpn the kingdom of
Great Britain, and H. Pinckney Walker of
Charleston ju the state of South Carolina, a sub
ject of Great Britain, trustees under the first
mortgage of the South Carolina Railroad Com
pany, are not inhabitants of. and are returned
by the marshal not to be found within the said
d.si riot, and have not voluntarily appeared in
the said cause. It is on motion of the compiain
nt’s solicitor ordered:
I. That such absent defendants are nereby
commanded and directed to be and appear at
the clerk's office in the city of Savannah at rules
to be had on the FIRST MONDAY IN JULY,
18J0, then and there to demur, plead or answer
to those things which have been objected
against them in the above slated bill of com
plaint. also to show cause why the temporary in
injunction granted and receiver appointed in
the said cause should not be continued of force
and made permanent, and to do further, and
receive what the said court should have consid
ered in that behalf.
11. Ordered further, that a copy of this order
shall be served upon such of said defendants
as have not been found in the Southern District
of Georgia by the marshal of any district in
the United States in which said defendants
may reside or be found. And that this order be
published once a week for six consecutive
weeks in the Savannah News, newspaper pub
lished in the city of Savannah, Georgia, for no
tice to such of said defendants as may not be
served with a copy as aforesaid. Aud that upon
proof made to the court of proper efforts to
perfect service as herein provided, and of tbo
publication of this order as aforesaid, and that
the _ court proceed to entertain jurisdiction
against said defendants and decree the relief
prayed for by complainant according to the
statute in such case made and provided.

of the Sheriff that the defendant does not re
side in the couuty of Chatham, and it further
appearing by the affidavit of said Sheriff and
petition of said plaintiff that defendant does
not reside in the state of Georgia; it is, there
fore, considered, ordered and adjudged by said
court that service bo perfected on said defend
ant by the publication of this order twice a
month for two months before the December
term, 1890, of this court, in the Savannah Morn
ing News, a public gazette, published in the
said county and state, and the same being the
paper in which Sheriff's advertisements are
printed.

One Hundred Dollars ($100) each.

forth, petitioners ask that said company shall

and preferred stock; to increase the said capi

and dispose of the stock, securities and obliga
tions of any other corporation now or hereafter
to be formed under the laws of this or any
other state or territory, or of the United States;
to lend or borrow money on note, bill, bond,
pledge, deed, mortgage, or other obligation or
lien, with or without real or personal security.
Stockholders who have paid their stock sub
scription in full to be iuno wise liablo for the
debts o? the corporation nor for any wrongs
committed by it.
Wherefore, petitioners pray that they and
their associates may be Incorporated as afore
said 'or the term of twenty (20) years, with the

The capital stock of said corporation to be
