the Court Booms.
The superior court grand jury will con
yene at 4 o’clock this afternoon.
Id the superior court yesterday the Mul
ler case in which the heirs ask for an ac
counting in the estate of Martin Muller, was
°°ln* criminal court yesterday, in
the*absence of Solicitor General Fraser,
who IS attending the Liberty county court,
Mr Osborne. Ksq-, was appointed acting
solicitor general, and the following con
victions were had:
Thomas Holmes, *25 or two months for
assault and battery.
YVilliam Prenty, ?50 or four months for
mnvhem. Prenty chewed up the nasal
organ of Timothy Sullivan in a rough-and
tumble fieht. . .
Diana Gaines was sentenced to six months
for the larceny of 58 8U from the children of
T J. Sheftall.
"William Henry was sent to the gang for
six months for the larceny of half a box of
tobacco from W. Bartley.
Henry Tyson was fined J 25 or two months
on the gang for carrying concealed weapons,
and, on the payment of costs, a nolle pro
sequi was entered on a second charge of wife
beating. ...
At the hour of adjournment in the city
court the damage suit of Lucy Green (col
ored) against the City and (Suburban and
the Coast Cine railroad companies was in
progress, and its further consideration will
tie resumed this morning, the plaintiff hav
ing closed its testimony. The suit is for
15,600 for the killing of plaintiff’s husband
ou'the bridge of the Coast Line road near
Bonaventure by an excursion train during
Mav week. Father and son were killed to
gether. The accident was detailed in the
Morning News the da? following its oc
currence.
Matt O’Connell, carpenter and agent for
Salomon Cohen, hail two painters, Lundy
and O’Neill, arrested yesterday in Justice
Elsinger’s court, charged with cheating and
swindling to the amount of 530 worth of
paint, diverted to buildings other than
those belonging to Mr. Cohen, which they
were employed to paint. The painters say
that there is no ground for the charge, but
that it grew out of the discharge by
Mr. O’Neill of an impudent and
incompetent colored painter. The par
ties gave bond and promise some rich
developments. Mr. Lundy says he proposes
to sue for the balance due by Cohen, as the
latter’s agent, instead of paying him his
wages last Saturday, gave him a written
notice that he would withhold what was
due him until he had investigated the
charges, which, the painters say, were
trumped up by the negro. O’Neill has been a
resilient of Savannah for tweuty-fivo years
and Lundy for the last five years. They
were highly indignant over their arrest,
and say that they can abundantly prove
their innocence and will retaliate by suits
for wages due and for damages.
RAIL AND CROSSTIE.
The Savannah, Florida and Western road
is carrying a number ol Savannahians to
Suwanee Springs resort.
J. C. Haile, agent of the Central at
Columbus, spent yesterday in the city and
returned home last night.
D. H. Bythewood, division passenger
agent of the Central at Columbus, returned
to his post last night after spendiug a couple
of days in Savannah.
Capt. Tyler, general manager of the At
lanta and West Point railroad, spent yes
terday in Savannah and returned to Atlanta
last night over the Central in his special
car.
The Central’s summer travel is remark
able. The passenger train was crowded
last night. An extra sleeping car was put
6n the Atlanta line last night and another
on the Augusta and Spartanburg route.
The railroads In (Massachusetts are not
slow In taking advantage of the now law
providing for the abolition of grade cross
ings. The Boston and Albany has already
entered a petition for the changing of the
grades at five crossings, all within a length
of five miles of road and in country dis
tricts where land damages are presumably
small.
Propositions, says the Enquirer , are in
progress for building anew irou bridge
across the Chattahoochee river at Columbus
to take the place of the present wooden
structure of the Mobile and Girard road.
The iron bridge for the Columbus and West
ern road was completed about a year ago at
a cost of about $45,000. The Mobile and
Girard bridge will cost the Central railroad
not less than #50,000, as the masonry will be
much more expensive than that of the Co
lumbus and Western br.dgo.

yesterday by Chr. G. Dahl & Cos. for Poo
teetoff Harbor, with 3,711 barrels of rosin,
weighing 1,772,300 nounds, valued at #10,900.

Norwegian bark Leif, for London, with
2,469 barrels spirits turpentine, measuring

What Does it Mean?
Editor Morning News: In the Times of
y&sterday, under head of ‘‘Before the
Mayor,” appeared the following: ‘‘Ben Hill
(colored), obstructing sidewalk on Brough
ton and Barnard streets ou Saturday night,
was fined $5; Joe Ready (colored), for in
terfering with officer who arrested Hill, was
fined sl, and James Bacon, for drawing a
knife and attempting to cut a citizen, was
fined $3.”
It appears to us that considerable want of
judgment has been displayed in the above.
The man who committed the least offense,
simply obstructing the sidewalk, was fined
tho greatest amount, while he who interfered
with the arresting officer, a very grave of
fense, was let off with a nominal fine ($1),
and the one committing a criminal act, for
which he should have been turned over to a
higher court, was fined the paltry sum of
It strikes us that in the latter case the
mayor had no jurisdiction, and in the two
former his judgment was sadly at fault.

New York, July 14.—At Brighton Beach
to-day, in the first race. Bender was on the
Wab-Ta-Wah gelding, and could have been
second or third, but just before reaching
the finish he pulled his horse to a standstill.
The riding of Flynn on the Emmett filly

James A. Simmons Said to Have Been
In With Classen.
New York, July 14. —James A. Sim
mous was arrested this afternoon at his
office, No. 45 Broadway, on a warrant
issued by United States Commissioner
Shields on application of United States
District Attorney Mitchell. Simmons is
accused of complicity with Gen. Peter J.
Classen in misappropriating bonds and
securities of the Sixth National Bank. His
examination was set down for to-morrofr
and his bail wets fixed at $25,000. He dtd
not give bail to-dav. Simmons took bis
arrest very calmly. He declined to say any
thing except that bis oaso will be developed
later.

associate* have formed themselves into an
association and desire for themselves, their
associates and successors to be incorporated
and made a body politic, in accordance with the
laws of th- state of Georgia, for a term of

ing their charter at the expiration of said term,

factories and such other property, real and per
sonal, as may subserve the proper conduct of
thetr business; the selling, mortgaging, leasing

purposes of their organization, with the further
fight to issue notes, bonds and other evidences
of debt and to secure the same by such deeds

erty as may be desired, and with the right to do
all such things as are usual, or incident, to the
business of persons or corporalions engaged in

That their capital stock to be used in said
business is the sum of fifty thousand (50,000)
dollars, all of which has been subscribed for by
your petitioners and associates aud which is to
be actually paid in as the board of directors of
said company may require, each subscriber be
ing liable for the amount sut>acriled for by him
until the said subscription is fully paid up, ami
no further, but they desire and ask for the
right to increase their said capital stock from
time to time, iu the discretion of the board of
director* of saitl company, to any amount not
to exceed in all the sum of two million (2,000,000)
dollars, and of decreasing said increased capi
tal st>ck similarly not below said original capi
tal of fifty thousand (50.000) dollars.
That the principal office and place of business
of said company shall be in Chatham county,
in the state* of Georgia, but your petitioners de
sire and ask that the right be conferred on said
company to have agencies and offices and to
carry on said business, or any branch thereof,
at such other places in and out of this state as
may be deemed necessary and profitable to said
company and a* their corporate and business
interest may from time to time suggest, ami
particularly the right to own. purchase, sell
and deal iu lands, rights in land and phosphate
rock, and the carrying on of their business of
manufacturing fertilizers and dredging, mining
and digging of phosphate rock in the state of
Florida.
Wherefore, your petitioners pray that they
anti their associates may be incorporated for
the purposes aforesaid, and that th* y may have
conferred on them, their associates and sue
