the Trouble.

Yarn has published his sworn statement,
from which it appears to me that he is try
in addition to the trouble already caused by
his orders, to slander the names of myself

termed, all of which we have tae evidence

advise the negroes to leave off work and re
port to Mr. Varn, thinking then he would
take legal steps to eject me
if bis title should better than mine.
Upon our arrival at Knight’s house the
negroes were in the shed. Upon seeing us
they jumped, ran Into the house and got
their guus and come at us in a threatening
manner, whereupon Hendrix and McLen
don both threw up their hands and cried
out, “Boys, don’t shoot, we are not
here for that purpose, but to talk
to yon." They did not heed this appeal, but'
opened and kept firing on us, and we were
forced to shoot In defense of our lives.
1 had built on this lot No. 2, and It was
mv borne, and it will appear to every rea
sonable mau that had Mr. Yarn wanted to
hare done nothing except by legal terms, as
published in his circular, he would have
served a bill of injunction upon me, as any
man wou.d do who desired, as his circular
claims, to have obeyed the law. He jVaro)
never notified me he would submit
to legal process, and be we 1
knows it. He claims I waylaid and
shot his negro tearuster. If I cannot prove
an alibi, why of course I will have to
suffer the full penalty of the law, and all L
ask is an investigate n before the courts.
I can prove teat I never went with a gun
and oidered bis hands off, or any hand, un
der his employ. I leave it thus far to a
verdict rendered by the public.

Editor Morning News-. In reference to
the publication in Sunday’s Morning
News of the 110,000 damage suit of W. W.
Barrough against me, 1 wish to state that
the allegations contained in plaintiff’s dec
laration are false so far as they relate to
any negligence on my part in the treatment
of the case. The lac a are, about uree
months and a half after Banough’s alleged
injuries, X was requested by Dr. J. G. Keiler
to visit some of his patients, as be was sick
and could not ma.e the calls. One of these
patients was Barrough. I visited bi:n three
times, viz.: on March 31, April 1 and 2, and
then requested him if he needed any
further attention to call his attending phy
sician, Dr. J. G. Keller, as I had learned
that the doctor was out and able to attend
to business again. I heard nothing further
from Barrough until he summoned me as a
witnes -in his SIO,O )0 damage suit against
the Belt Li e railroad. I was not
sent to see Barrough to perform any
surgical operation or to diag iose a y
brosen r bs. I found Bar. ougn with a slight
fever and a simple case of diarrhoea—for
which 1 treated him—but fouad lus tem
perature normal on my third visit, and left
the case as above.
You will see that Barrough says he was
injured on Dec. 15, 1889, and that I at
tended him for three months, when the
facts are I saw him for the first time on
March 81,1890, and only visited him three
times, as above. Very respectfully,
