Charles H. Olmstead and James Sullivan,
trustees for the mortgage bondholders of
tbe late Savannah Times Publishing Com
pany, together with other creditors, peti
tioned the superior court yesterday for an
Injunction, receiver and other relief against
the defunct corporation of Ga/.away Hart
ridge, Esq., and Justice M. Naughtitf.
After going into a voluminous description
of theso claims and mortgages the plaintiffs
set up a plea against the distribution by
Justice Naughtin of the funds In his bands
realiz-d from garnishment upon debtors to
secure claims of employes, holding that
there is a question whether Justice Naugh
tin’s court is held at the proper time and
place for the holding of justice’s court In the
Third district.
Judge Falligant granted a temporary
restraining order, and ordered the defend
ants to show cause this morning at 10
o'clock why the injunction should not bo
grunted and a receiver appointed. In the
meanwhile he appointed Gugis Bourquin
temporary receiver to take charge of the
assets ana the property of the Times com
pany aud tbe llartrldge mortgage. The
merits of the suit will be tried at the March
term of the oourt, Denmark, Adams &
Adams, Norwood & Cronk and R. R. Rich
ards represent the plaintiffs. The document
covers eighteen pages of closely written
foolscap and shows too affairs of the late
publishing company to be in a very compli
cated condition.
In the superior court yesterday the cases
of M. S. ft D. A. ByckandTh inas Gainhlo
vs. the Savannah i imes Publishing Com
pany, appeal from Justice Naughtlu’s
court, were tried. The juries found for the
plaintiffs in both causes, #OB 93 in the former
end #IOO in the latter. In both cases the
juries stated they considered the appeals
trivoious and only for the ourpuse of delay.
Under theso verdicts the plaintiffs are given
the right to enter a claim for 20 per cent
damages.
Judge Falligant granted an order author
izing Sigmund Schreinor, administrator of
the estate of Herman L. Schreiner, to sell a
Ceutral railroad debenture bond to meet
extraordinary expense of the estate.
T. D. Rockwell, Esq., was appointed a
notary public by Judge Falligant.
Tbe city court was occupied all day in the
trial of the #IO,OOO damage suit of T. D.
Harnett and Mrs. Catherine Harnett
against the Savannah and Atlantic railway.
The suit was based on injuties received by
Mrs. Harnett, who was thrown from a
train at Lano’s Beach house at Tybee, May
24, 1891, by the lurching of the car, which
she claimed was tbe result of negligence on
the part of the company’s agents. The jury
hadn’t returned a verdict at a late hour last
night Morrison & llartrldge represented
tne plaintiff and Lawton & Cunningham
appeared for the defendant corporation.
Tbe criminal session of the superior oourt
will not be taken up till next T uesday, and
then Solicitor General Fraser savs he will
rush tlnugs in a lively manner so as to clear
the jail. He expects to reach some of the
murder cases about Dec. 23. The trial
of the train robbers, Do Laughter,
Turner and Perkins, has been set for
Dec. 29. Hon. F. G. dußignon will assist
the state in the prosecution. DeLaughter
will be defended bv Seabrooke & Morgan of
this city and probably F. W. Pope, Esq., of
Jacksonville. Hereditary insanity, it is
■aid, will be the principal plea of the de
fense in his case. Turner will bo repre
sented by Judge D. A. O’Byrue, and Perkins
will have to rely on an appointment by the
court, us be doesn’t appear to have any self
sacrificing friends willing to employ coun
sel for him.

A Friend of the Alleged Thrashed
Groom Says It Isn't to.
A friend of the groom, whom the Morn
ing News stated day before yesterday had
been pummelled by his mother and the
relatives of the bride for getting married
without consent, denies the truth of the
story, although it was based on a state
ment from the police.
Mr. Gus Boulineau and Miss Rachel
Marsh urrnnged to get married and went
to a friend’s house and summoned Rev. Mr.
Ulenus. The mother of the bride went to
the house aud objected. Mr. Boulineau told
her it was no use to object, because ho and
the young lady were determined to
bo married. Mrs. Marsh said it
was not proper to be married in such a man
ner without witnesses, but the groom in
formed her that he had half a dozen friends
waiting to witness the ceremony and in
vited her to become oue of the party. She
declined and then began to scream. This at
tracted the attention of a policeman, to
whom Mrs. Marsh appealed to stop the
marriage, but he told tier no one could stop
the proceedings if a license had been se
cured. Then she quieted and acquiesced.
Rev. Mr. Blenus performed the ceremony.
The story of the groom getting drunk,
ibe friend said,.was without foundation,
because Boulineau never left the house after
the marriage, and, instead, held a pleasant
reception to his friends end those of the
bride, at which thoro was an abundance of
wines, which obviated any necessity of
going outside to secure liquid refreshments.

Breaker in Jail.
Officer Bossell has made an important
capture in the arrest of Joe Williams (col
ored), who is in jail charged with stealing
a pistol and other articles from Capt. Her
naudez.
Several pawn tickets wero found in his
pockets, which unearthed the fact that Will
iams has been carrying on systematic burg
laries of stores in the eastern part of the
city for some time. So far, the robbery of
Uupt.J. H. Johnston’s barber shop, at Jones
and East Broa#l streets, which was entered
one night last week and stripped of almost
every movable article, hns been laid to the
negro’s credit, together with the robbery of
several Greek fruit stores,
Williams operated with skeleton koys, a
ouuch of whloh was found upon him.

negro at his trial to guarantee him a long
term of service In Georgia's lock-step de
partment of public works.

A Schooner Picks Up Twenty-one
Bales of Cotton at Sea.
Brunswick, Ga. , Deo. 11.—The fruiting
schooner Pajaroc, Capt. Albury, arrived
to-day frem Nassau with twenty-one bales
of cotton picked up in the Gulf stream.
Capt. Albury reports that heavy seas pre
vented him from securing many other bales
floating m the stream. The cotton is sup
posed to be part of 1,000 bales thrown from
the steamship l'rejurne while stranded off
Cape Florida.
To-morrow Brunswick’s municipal e ec

At a meeting of the board of trade to-day
resolutions were passed asking council to
Join with tbe board in requesting the rail
road commissioners to order the Brunswick
and Western and East Tennessee to build a
union passenger depot here. All trains

THE POET EOCIETY CONCERT.
A Large Attendance Despite the In
clement Weather.
In spite of tbe inclement weather last
night the Port Society concert at the sail
ors’ reeding rooms, was largely attended,
both by seamen and citizens. Mr. R. B.
Reppard, being the senior member of the
board of directors of the Port Society pres
ent, was asked to take charge of the con
cert.
The first number on the programme wa9
a piano duet by Misses Coldlug ah.l Smith,
which was followed with a song by Mr.
Billington, after which MissColdiug pleased
the audience with a vocal solo. The lady
wa compelled to respond to the repeated
applause.
Mrs. Finnic and Miss Cosens sang vooal
duette, ‘’Till We Meet Again,” and were
forced to repeat a portion of it in respjnse
to an encore.
Prof. W. N.Smith added much to thesuo
cets of the concert by singing several coimc
songs, ail of which were familiar, and in
the choruses of which the audience joined.

Amateurs.
The article In the Morning News a few
days ago relative to the ’’crack ’ pool sho’s
of Savannah, has stirred up the 1 vers of
tbe game and succeeded iu bringing a num
ber of professional shots to tho city, who
are anxious to carry off somobo ly’s money
in a match game.
Oiie of tho professionals now here is deaf
and dumb, but these physical infirmities do
not seem to hinder him from being a re
markable adept with the handling of a cue.
Another young man who came to Ba
vannuh for the ostensible purpose of eurlob
ing his exchequer by playing pool for stakes,
is badly disappointed with the condition of
things, aud said lost night he intended
leaving this morning.
The Savannah shots say they will not
combat a professional hailing from other
shores. Homo talent is what they want to
compete with.

A SOENE IN COURT.
Col. Anderson FJected From the Su
perior Court by Fcrce.
Col. Clifford Andorson made quite a sen
sational scene in the superior court yester
day by Interfering with tbe progress of a
case in which he was interested. Col. An
derson desired to represent himself, and on
being given counsel by tho court refused to
acquiesce, and disturbed the proceedings of
the conrt to such an extent that Judge Fal
ligant was compelled to have him removed
from the room by force. Four deputy
sheriffs wore required to execute the order
of the court because of Col. Anderson’s re
sistance. The scene created considerable
excitement. The case was continued until
this morning.

tal stock to any sum not exceeding the sum of

its capital stock, and to give to its hoard of
directors such powers as it may deem neces

stockholder who has paid In the full amount of
