State HEARST ACCEPTS THE NOMINATION He and Judge Gaynor, Opposing Candidates, Speak—Latter Is sues Challenge for Debate and Scores the Democratic Nominee NEW YORK, Oct. 12.-William Ran rdolph Hearst and William G. Gaynor, the two candidates for mayor of Greater New York, who have been engaged in bitter denunciation of each other during the last two days,- appeared before the public lari night for their first address of the campaign. Hearst spoke at Carnegie hall, in New York, and formally accepted the nomina tion of the Independents, known as the Civic Alliance. Gaynor appeared at the Academy of Music, in Brooklyn, as the regular Democratic nominee. NO ATTACK BY HEARST. In his formal address Hearst refrained from attacking his rival, but Justice Gaynor, in his speech, aroused by what he declared to be Hearst’s breach of faith in repudiating him. challenged the editor to meet him in joint debate on the is sues of the campaign. "I want fair play above all in this con test.” said Judge Gaynor. "The open enemy I honor, but I despise the enemy that sits back as an editor or otherwise —pretending to be your friend, when he is only smiling while he hurls his dagger in your ribs. Ivins, who was the Repub lican candidate for mayor four years ago. took an important part in the Hearst meeting. In fact, it was Ivins who made the bitterest attack on Gaynor. Among other things, he said that Justice Gay nor had participated in a conference at a hotel in this city in which he advised State Senator Patrick H. McCarren and a man whom Ivins described as a "lobby ist.” that the anti-race track gambling law. as passed by the legislature in this state, was unconstitutional. Taliaferro, of Opelika, Ala., to serve as pastor to fill the vacancy re cently made by the resignation of Rev. Allen Fort, who has accepted the call to the Baptist Tabernacle, of Chattanooga. The Development of the Telephone The telephone is not so old. There are among us yet those who remember how they viewed with awe the little box-like Instrument that was exhibited at the Cen tennial Exposition of 1876. Crude and imperfect though It was. It actually transmitted the human voice, something that had been attempted with out success many times before. Xt that time but few realized its value or fully believed the statements made about it. Today everyone recognizes the true worth of the telephone. Without It business would be paralyzed, the comfort and safe ty of our homes would be Imperiled and the general stability of the country af fected. The present perfection of the telephone is due mainly to the efforts of the West ern Electric Cmpany, of New York. Chi cago and other large cities. This com pany took the undeveloped Invention of Alexander Graham Bell shortly after the Exposition, and during these thirty-three years has been constantly delving into the theory of the telephone, and at the same time perfecting machinery for the manufacture and testing of every piece of material going into its construction. Not only' does tlje Western Electric Company make telephones for city use, but it also manufactures telephones and supplies for rural telephone systems whether the system consists of only four or five subscribers or is one that supplies service to a village of several hundred or more inhabitants. Oct. 12.—Although his pass book showed he had a balance of over $1,500 in the Fourth National Bank, of Atlanta, P. j. Fallen, a concrete ' contractor of that city who committed suicide here a week ago, was buried as a pauper today. The body was held for a week, while his son. who is supposed to reside at No. 601 Carondolet street, New Orleans, Tj» , was wired, but no response came, and the coroner today ordered the body in terred in the potter’s field. Investigation failed to disclose any rela tives of the dead man in Atlanta, nor was any account held by a local bank. 4 KILLED, 20 HURT, IN TEXAS WRECK DALLAS. Tex.. Qct. 12.—Four people were killed, one man was fatally injured, , and a score of others were less seri ously hurt in a collision near Greenville. Tex., today on the Missouri. Kansas and Texas railroad. The wreck occurred at a small watering station, eight miles north of Greenville. A freight train had stopped for water when another, carrying a crowd of carni val people en route to the Dallas State fair, struck the rear end. Four persons were killed outright, while the fifth man Is so badly injured that death is mo mentarily expected. The dead and injured were sent to Dal las. JORDAN WILL NOT RUN FOR RE-ELECTION COLUMBUS, Ga.. Oct. 12.—0. 8. Jor dan, superintendent of the Eagle and Phe nix Cotton mills, who has represented the Third ward in the city council for some time announced last night that he would not be a candidate for re-election in the approaching primary. The above announcement leaves only two prospective candidates in the field from that ward—R. M. Norman and W. A. Kline. WHEN IS TELEPHONE CONTRACT BINDING? •Can a valid contract be made over a telephone when neither man is personally acquainted with the other to whom he is talking over the wire? Or. to put it more broadly, what elements are necessary to constitute a legal contract made with the hello girl as an Intermediary? Blackstone didn’t have anything defi nite to say along these lines, and even Chitty on Contracts fails for obvious rea sons to elucidate. Judge Calhoun is try Ing in the civil branch of the city court Tuesday a case which is of little Import ance in itself, but which will likely go to the higher courts and become a prece dent in Georgia in questions relative to telephone contracts. It is that of Pritch ett vs. the Pullman company, a trained nurse suing for SSOO because the Pull man people, It is alleged, carried her be yond her destination and caused her to lose certain employment. One Dr. Smith, of Hawkinsville, It is alleged, telephoned one day to a clerk In the Elkin-Watson Drug company, stat ing that one of his patients in Hawkins ville needed the attention of a trained nurse, and asking the drug clerk, who kept a nurses' register, to send him a nurse. This the clerk, it is alleged, agreed to do, and sent Miss Pritchett. She was carried out of her way by the Pullman company, was caused to reach Hawkinsville two or three days, or more, late, and found the place had already been filled. So she sued the Pullman company. Now one of the allegations set up in de fense is that the Pullman company could not have caused her to break her con tract because she never had a valid con tract, the telephone conversation ber tween the doctor and the drug clerk, not constituting a legal contract, according to the position taken by the defense. On this point, among others, the case will likely be appealed, no matter which way it is decided in the lower court and when it goes to the higher court, then the learned judges will have to go deep into the question of what is and what is not a valid contract when made over the phone, and will hand down an opinion which will be cited in similar Georgia cases for years to come. Miss Pritchett, the trained nurse who sued the Pullman company, before Judge Calhoun Tuesday morning, for carrying her beyond her destination, was given a verdict of S2OO and costs shortly afternoon. START A CAMPAIGN AGAINST FAKE FISH CHICAGO, 111., Oct 12.—The state food commission yesterday starred g crusade against dealers deceiving the public with artificially colored and smoked fish, hams, bacon, sausage and other edibles. The Investigators had their atten tion attracted to the cheap prices at which smoked salmon was offered. Ex amination showed that most of the "salmon” in the market was carp from the Fox river and other nearby streams. They t were first given a both of p.'nk paint and then subjected to treatment in "liquid smoke." Th3 ingredients of these are not classed as deadly poison, but are recognized as having “accumu lative effect." meaning that constant consumptior will producs death. McDonald was indignant and protested to the superintendent of the cemetery. He looked up the records and found that her relative wi* really burled some distance from the grave which she bad been so talthtuih decorating. A. B. RICHMOND, Vh., Oct. 12.—The At lanta and Birmingham Air Line rail way, operating 287 jfilles; the Florida West Shore railway, operating 70 mites; the Plant City, Arcadia and Gulf rail way, operating 20 rtiiles, and the Talla hassee and Southeastern railroad, oper ating 89 miles, were merged with the Seaboard Air Line railway as of Sep tember 29 and 30, 1909, according to statements given out by John Skeltdn Williams. This increases the operated mileage by nearly 400 miles, so that the mile age operated or owned by the Seaboard Air Line, from October 1, 1909, will be just 3,000 miles. These several subsidiary roads have been controlled heretofore, but have been operated separately. Their oper ations hereafter will be included in the operations of the Seaboard system proper. Following this statement Mr. Wil liams added: “I regret to see that some newspa pers which do not entirely understand the situation and some of my enthusi astic friends are too much disposed to herald the recent action at New York in electing myself and some of my friends to the Seaboard directorate as a williams victory. This is the wrong view. The action is not a victory or a defeat for anybody and was not so intended. Tnere has been no fight since the receiversiUp. It was simply a case of those most heavily and di rectly Interested in the Seaboard get ting together to harmonize all interests and to insure peace and effective working.” Mr. Williams declined to discuss the future presidency of the road. 64 CASES, WITH RELICS OF HUNT, ARRIVE HERE NEW YORK.
