Scott, execute a joint bond to tho said Susan C
in the penal sum of four thousand dollars condi

certain indenture of mortgage, whereby he

1824. with interest ut 7 per cent per annum, by
his indenture, under his seal, bearing date the
day and year first aforesaid, mortgaged to tlie
said John Retail, all .the undivided inoicty # or
hail* part of ail tlmt lot of land, situate, lying and
being iu the city of Savannah, and. known and
distinguished in the plan thereof by the number
one (1) Tyrcouneli tything Darby ward, together
with the appurtenances, kind further staling that
the said promissory note remuins wholy unpaid,

said cohnty, on the 9th October 182?, in tlie sum
of Five Hundred Dollars, puyalde with Interest
from the date on the first day of January then
next ensuing, did mortgage to the suid Henry his
heirs and assigns, to secure the payment of the
note aforesaid with interest on the same—u cer
tain lot of land in the town aforesaid being part
of lot No. i beginning at the west corner of a
Jot belonging to one Calvin Hayes, thence rim
ing south JOO feet on St. Marys Street, thence
north to Bryant St. east to C. Hays’ land thence
south to the beginning, with tho margin attached
to the same on the south side of St. Murys or
Bay st. being a hundred feet on the street and
running from thence directly to the river St.
Murys, together with all and singulur every tiling
thereto appertaining,that thesaidllenry Saddler!
to whom and to whpse heirs und assigns the said
mortgage w as made on the 24tli ol Sept. 1823,
July assigned by deed, said mortgage to the pe
titioner, there is now due on said mortgage the
sum ot Five Hundred Dollars with interest from,
the 1st January 1822, and praying for the foreclo
sure of the equity of redemption, in,the said John
Christopher, Ins heirs and assigns iu (he
mortgaged premises and that the same he
foreclosed according to law.
