W HEREAS, the river’Savannah is
frequently injured by the project
ing uf tite wharf heads Into, the river, be
yond the line of the authorised survey ol
th.e wharf lots, and by tho sliding, washing
or e.nvlng in of the material with which the
wharves tire filled in, in consequence o
thedcleotivc imititierinwhiohsaid wit,tries
nro constructed, or in bottseiqueiico of some
decay, or .want of reparation.
Sec. 1. Be it therefore enacted by the Se
nate and House nf Representatives of the
state nf Georgia in General Assembly met.
and it it hereby enact'd by the authority nj
the same, That it shall be the duty of the
eominitaioners of pilotage for the Bar and
River Savannah, and they arc h.erehy au
thorised to visit, inspect end examine, an
nually, In the month of June, the several
wharves on said river between Ray's Hall
and tho ocean! and should any wharf soon
to them to require repair, tvhorehy injury to'
the river, in their opinion, maybe prevent
ed, they shall cause the same to be inspect
ed and surveyed by an abler mat of the city
of Savannah, a wharf holder, am) a mas
ter carpenter nr wharf builder, aiid if said
surveyors, or a .majority of them, shall he
of the’ opinion flint said wharf requires re
pair, then the owner or owners, tenant or
tenants thereof, his. Iter or their agent nr
agentii, representative nr representatives,,
than within three months-thereafter, well
and sufficicntly-in tho opinion of said sur
veyors, or a majority of them, repair, or
cause to be repaired, said wharf, sp deem
ed to bo in need thereof; and ifltc, site, or
they, shall refuse, fail or neglect so to re
pair said wharf, or cause it to ho repaired,
within the time aforesaid, it shall be the
duty of said commissioners to causo tho
same tu be repaired and the owner or our
ers, tenant nr tenants pf tpclt wharf, his.
hot, or their ngcul or representatives, shall
forfeit and pay to the commissioners foj
tho use of said river, the sum of two hun
dred dollars, together with all tho costs,
charges and expenses of the repairs,; to lie
rernvered in any court of competent juris
diction; anti which may be levied by dis
tress and sulenf said wharves and the lot or
lots thereupon appertaining, nr by any oth
cr execution nr process against the person
or property uf the defendant'.
§ 2. And be it further enacted bythe air
Ihority aforesaid, That If any vessel, boat,
fiat, ark.'bulk, wreck, crib, rad,or ereetion
shall lie sunk, or caused, or permitted.

thority ajhresaid, That whenever an ac
lion, or cause of action shall accrue or
tise w ithin the intent or meaning of that
act, the affidavit whet con to found an m
tachment nrotlier legal proceeding, or to
hold the defendant or defendants to bail
thereon, may lie made by the chairman ol
said commissioners or tlteir agent.
§ 9. And be it further enacted, That
this act shall he published at the expense
ol tho aforesaid commissioners, . once
