Near The Fairgrounds 229-436-1507 Special to the Ledger by Gail Drake Off the southern coast of France, a young merchant sailor named Edmond Dantes guided his vessel the Pharaon into port, returning to Marseilles to marry his beautiful fiancee Mercedes. He was flush with the news of his promotion to cap tain. In his hand he held two objects. His dying captain had charged him to deliver a package to a comrade of the exiled Napolean Bonapart, and a letter to an unidentified man in Paris. As Edmond and his fiancee pursued wedding festivities, he noticed two men huddled in a cor ner—Danglars, another merchant sailor jealous of his promotion, and Mon- dego, a rival for his bride’s affections. On the eve of his wedding, suddenly some soldiers arrested him - for treason as a Bonapartist traitor. Edmond was stunned! He had never participated in any political activ ity. He was taken before the magistrate, Villefort. Edmond explained his status and was assured the case would be quickly discharged. He showed the package and letter to Villefort - and the mag istrate’s face turned gray. Immediately the letter was tossed into the fireplace - to destroy evidence that could hurt Edmond, said the judge. He directed Edmond to return the next day after a night in jail. The next morning Dantes was brought before the judge - who quickly sentenced him to life imprisonment. Shack led, he was loaded into a boat and rowed over to the famed Chateau D’lf, an island fortress prison. No opportunity to see the evidence or respond to the charges. No opportunity to face his anonymous accusers. No opportunity for a fair hearing before an impar tial jury or judge. And so begins “The Count of Monte Cristo,” Alexandre Dumas’ classic story of injustice, revenge, forgiveness and hope. Such was the judicial sys tem in France and much of the world, in contrast to the liberties protected by the U.S. Constitution. The Fifth Amendment provides, “No person shall ... be deprived of life, liberty or property with out due process of law.” As Americans we take for granted fundamental freedoms imbedded in our foundational documents. But injustice has existed since men walked this SPRlPlKLER UPGRADE Gain greater water efficiency and save thousands in energy bills by converting to low-pressure sprinkler technology. On the eve of Passover, over 2000 years ago, a teacher and healer called Jesus was praying with his disciples in the Garden of Gethsemane. Suddenly a mob accosted him in the middle of the night with swords and torches, ar rested him, and marched him over to the house of the high priest. A large gathering of angry Jewish leaders was assembled, shouting accusations. Accusation after accusa tions—but they were all inconsistent. Jesus had been arrested without an established charge! Then the accused was denied an opportunity to answer each allegation. Finally a man shouted, “I heard him said he would destroy the temple and rebuild it in three days.” “I heard him say that too,” shouted another. “Blasphemy!” shouted the priest, “Why do we need any more witnesses? He is worthy of death!” But the criminal indictment writ ten over his head on the cross? “Jesus of Nazareth, the King of the Jews.” This illegal midnight court was a violation of so many of their own proce dural rules: no nighttime trials during feasts, ac cused men were given an opportunity to prepare a defense, no bribery of wit nesses (they paid Judas), and a night had to lapse before a death verdict. The U.S. Constitution follows the Christian Judeo ethic of “fundamen tal fairness” that requires “due process of law.” Part of that legal process includes the right to know in advance the charges brought against the ac cused and the opportu nity to answer. Edmond Dantes, an innocent man, was denied a just hearing and given a life sentence. The trial of the Christ also began with a violation of established proce dural rules that resulted in a death sentence. How grateful Americans should be for our fundamental rights and freedoms. “Establish justice in the courts” Amos 5:15 Gail Drake practices probate, mediation and children’s law in Lee County.
