Cole, the young man who has been locked in Falton county jail for several clays suspected of hav ing murdered an infant, was released yesterday morning ou an order from Judge Bio. dworth, who heard the testimony, and decided there was nothing to warrant Cole being he'd. The facts brought out were sub stant.inti.illy the same as before the coroner’s jury The evidence was purely circumstantial and not strong. Since liis arrest, Cole lias obstinately refused to t.dk, except that he always asserted his ivinoicnce. It will be remembered that one night several weeks ago he went into Papp iL bar with a box containing the body of a dead infant. He left bis burden in tlie bar, and was later arrested surpeotod of being a mmler er. He was locked in the station house and take before the coroner’s iury, but obstinately refused to testify He was then committed .to jail, where he has been ever since. He claimed he was entirely innocent ot having killed the child, and that he found the box containing the body on the Georgia railroad tracks.
