refusing to make returns to the Tax
Receivers in this state. Said May >r
and aldermen may relieve from such
double tax if they sec fit. The Mayor
and Aldermen shall as soon as practi
cably after the books have been closed
each year, carefully examine the. re
turns and correct all such as nrc
in their judgement incorrect, and as
sess the property returned at such val
ues as shall seem to them fair and
equitable, and add to any return the
full value of any property not Return
ed, and as soon as said assessments
and corrections, if any, nrc completed
the clerk shnll turn over the hooks
for that year to the treasurer of the
city who shall proceed to collect the
taxes as assessed by the Mayor and
Aldermen. The treasurer shall re
port to the Mayor and Aldermen all
taxes not collected when the hooks
for any year have been closed nnd the
Mayor and Aldermen shall order the
clerk to issue executions against all
persons who have failed to pay by
the date fixed for issit ing execution,
which execution shall be a lien second
only to the lien for state and county
taxes on all property owned by the
defaulting tax payers. The cxecu
tions shall be turned over to the
Marshall of said city who shall pro
ceed to collect themdn the same way
as executions for state taxes are col
lected and shall levy, advertise and
sell property subject to such execution
under the law governing Sheriffs in
levying, advertising and selling prop
erty under executions for shite and
county taxes. The deed of the Mar
shal of said city to any property sold
under any such execution shall pass
the title to said property to the pur
chaser as completely and absolutely
aithe deed of such defaulting tax
payer would have dtfne, provided
nowever, that any person whose prop
erty has been sold for taxes be allow
ed to redeem the same by paying to
tho purchaser at any time within
twelve months from the date of sale
the full amount of his bid with ten
per cent, premium thereon.
Section 19. Be it further enacted
by the authority aforesaid: That the
Mayor of Baid city shall hold a police
court as often ns may be necessary for
the trial of offenders against the by
laws ordinances, rules and regulations
of said city, and may when presiding
in said court punish any persons con
victed of violating any by law, ordi
nance, rule or regulation of said city
by sentencing said offender to pay a
fine not exceeding one hundred dol
lars, or to imprisonment in the guard
house of said city or the common jail
of said county, for any time not ex
ceeding sixty days, or to work on the
streets or public works of said city for
any time not exceeding ninety days,
and may imposo any [one or more of
these punisments for the same offence.'
Said court may snforce its judgements
by imprisonment in the guard house
or the common jail of Thomas county,
or work on the public works.
When presiding in said court the
Mayor shall have power to punish
for contempt of court any person
disturbing said court, refusing to
obey its mandates or iu any way
guilty os contempt thereof by fine
not to exceed twenty dollars for each
act of contempt or to contempt or to
commit to the guard house of said
city or the jail of said county of
Thomas, for any time not longer than
ten days. In the absence, sickness
or disqualification of the mayor the
mayor pro-tcmporc (the mayor and
aldermen being authorized heiYby to
elect one of the aldermen to serve as
mayor pro.tcmporc at such time as
they sec fit) shall have and may ex
ercise all the powers conferred, by
this charter upon the mayor. TIuj
marshal and clerk shall be the offi
cers of said court and shall have for
their attendance and services in said
court such fees as may be fixed by the
mayor and Aldermen which fees shall
ft collected as part of the penalty in
all cases of conviction. Any person
charged with any violation of the ordi
nance, rules or regulations of said
city shall, unless the offence is of such
a nature as to require the arrest and
confinement of the party, be served
by the marshal or any policeman of
said city with a copy of a summons,
signed by the clerk,and bearingtestin
the name of the mayor or mayor pro-
tem, setting out in a plain, summary
way the the nature of the oficncc
charged, and the time when and the
place where the party is required to
appear and stand a trial. The pre
siding officer of said court may re
quire bond and security for the ap
pearance of the party so summoned,
and in default thereof may commit
the offender to the guard house to
await a trial. Any party under bond
who shall tail to appear at the time
and place named in the bond shall be
liable to arrest and imprisonment,and
the court may dcclaic the bond for-
. foiled, and notify the securities there
of! that unless they produce their
principal within one week, judgment
will be entered up against them for
the amount of said bond, and execu
tion issued against said principal and
his sureties for the amount of

Nothing herein contained shall be
‘ to prevent the arrest
securty of said city, or prevent the
commision of a crime.
Section 20. Be it further enacted
by the authority aforesaid, That said
Mayor and Aldermen may enact any
and all by-laws, ordinances and regu
lations necessary to lay out a fire dis
trict in said city, and to enlarge, change
or modify Us limits from time to time,
and to prescribe when and how, and
of what materials buildings in said
limits may lie erected or covered, how
thick the walls must be, and how chim
neys and stove pipes and flues are to
be secured; and generally to do all
such things as llicy may deem nee
cssary to protect said city as far as
possible from the dangers of fire, and
prevent the spread ol any fire from one
building to others. They shall also
have authority to order any changes
in the construction or arrangement ol
chimneys, flues, stoves, or pipes,or die
removal thereof, when, m their judg
ment, the same are dangerous or likely
lo become so, and make the owner or
occupant ol the premises pay the ex
pense of such changes, which expenses
shall lie collected as taxes arc colli Ct

Section 21. Be it enacted by the
authority aforesaid, That the Mayor
and Aldermen shall have full power
and authority to compel all persons
resident in said city who are subject to
road duly under t.ic laws ol this stale
to work ihc streets of said city lor such
time, not exceeding 15 days in each
year, or lo pxy such a sum of money
not to exceed ten dollars in any one
year, as commutation lor such \york,
and in lieu thereof as the said Mayor
and Aldermen may ordain; and the
said Mayor and Aldermen may make
all ordinances necessary to carry this
power into effect, and to punish by fine
not exceeding twenty dollars or work
on the streets twenty days, any and all
persons subjects to road duly who re
fuse to work or pay the commutation.
Thirty days continuous residence in the
corporate limits of said city shall be
sufficient to constitute one a resident
ot said city so as to subject him to
liability to do strccl work.
Section 22. Be it further enacted
by the authority aforesaid, That when
ever a majority in frontage of the own
ers of property in two or more ad
joining blocks fronting on any
street shall petition, in writing, the
Mayor and Aldermen of said city to
have the street paved and curbed and
the side walks paved, said Mayor and
Aldermen may have said street and
side walk, either or both, paved and
curbed and assess two thirds of the
cost of such "curbing and paving upon
the property abutting on said street
according to frontage on said street,
as taxes, and shall, if necessary, issue
an execution against each piece of
property for the amount so assessed
against d, such execution lo be a lien
of the highest dignity against said
property until the same is paid, and
the property so subject be levied on
and sold by the Marshall, after adver
tising the same in the paper doing the
city printing, once a week for four
weeks before regular sheriff’s sales day,
and the Marshall’s deed shall operate
to convey title to the purchaser as ab
solutely as the deed of the holder or
owner of said lot would.
Section 23. lie it further enacted
by the authority aforesaid, That said
Mayor and Aldermen may appoint a
Board of Health consisting of not less
than five members, one of whom shall
be elected president by the members
of said Board, and shall be a reputable
physician in regular practice in said
city. Said Board of Health shall be
charged with the duty of looking after
the sanitation of the city, and shall
prescribe rules and regulations for
keeping the city in as good sanitary
condition as possible. The rules and
regulations adopted by said Board
shall be submitted to said .Mayor and
Aldermen, and, when approved by
them, shall be binding on all citizens,
and shall be enforced in the same
manner as the ordinances, and any
violation thereof shall subject the of
fender to arraignment before the
Mayor and punishment, on conviction
by tine, imprisonment, or work on
the streets, as in case of other viola
tions of the city ordinances. And
said Board of Health shall decide
when it is necessary to establish
quarantine against any place or dis
trict in order to guard against the
introduction of any contagious or in
fectious disease, and against what
points or what territory quarantine
shall be established, and how the
quarantine shall be enforced, and the
quarantine regulations, when furmu-
uluted by said Board and approved
by the Mayor and Aldermen, shall
be binding, and may be enforced by
the authority of the said Mayor and
Aldermen against all parties coming
into or passing through said city,
and any person or persons seeking to
enter said city who cannot show a
proi>er health certificate and other
proof required by said regulations,
may lie compelled to comply with all
quarantine regulations and be pun
ished lor any violations thereof by
fine not exceeding $100, imprison
ment under guard at the quarantine
station for any time not exceeding
60 days, or both. Said Board of
Health may order the removal of
any thing on the premises of any

or lot refuse or neglect to keep the
same in good condition the Board of
Health may have the same done at
the expense of said owner or occu
pants, or both. Said expense to be
collected as taxes are.
Section 21. Be it further enacted
by the authority aforesaid; That said
Mayor and Aldermen shall have full
power and authority to make, ordain
and enforce all such by-laws, rules,
ordinances and regulations as may
appear to them necessary and proper
for the security, welfare and interest
of said city, or for preserving the
health, peace, order, morals or good
government of the same, and shall
have, in addition thereto, all the
powers and authority granted to
towns or villages by Sections 779 and
782 to 790, inclusive, of the Code of
1882, not inconsistent or in conflict
with the provisions'of this charter.
