the Baltimore and Ohio, has been se
lected as the third arbitrator to act

in deciding the Atchison’s appeal from
one of Chairmau Caldwell’s decisions.
When the chairman' - ruled that the
Atchison was not justified in making a
$12 excursion rate to Denver and return,
that company appealed, to arbitration
and named A. E. Ford as one of the ar
bitrators. Caldwell objected to Ford
on the ground that he waa not a disin
terested party, whereupon t^e Atchison

present arbitration is to determine

Jailed Before the Marriage-
Abueville,S.C , Aug 26 - [Special.]
—Last night as the regular passerger
train was going through, which passes
Abbeville at 12 05 o’clock, a couple got
off the train. Your correspondent
could not learn their names, hut they
were from Georgia. The gentleman
asked a person who was standing by
where he could get somebody to marry
them. This yonrg man, Mr. J. Kenney
Milford, told the night police, who was
standing near, about what they wanted.
The police then investigated the matter
and found that it was a run away case.
Before the couple got to the hotel, the
young man was arrested. The girl
was sent to the hotel to await farther
orders. It was afterwards learned that
they were from a little station just be
yond Elberton. A telegram was re
ceived this morning from the young
lady’s brother telling the police to stop
them. He will arrive on the first train.
The annual meetiug ot the Abbeville
county survivors’ association met in
the court house last Tuesday. There
were some 200 new names enrolled, and
the crowd is estimated at 2,000, a num
ber of ladies being among the number.

Ace Not Legal Jurors.
Cheyenne, Aug. 25.—In an opinion
rendered, the Wyoming Supreme court
rather questions the state constitution
in vesting women with all the political
tights and privileges of the other sex.
The court said somewhat significantly
that it did not care to discuss the ques
tion, although it was raised in the case
at bar.
The defendant in the oase is a con
victed horse thief trying to get ont of
serving a term , of eigbt years. He
makes the point that women were not
called to serve on the jury which found
him guilty. Tiie court answered that
if a grievance exists, it is with the
women themselves, and not with the
men.
Women have served as jurors bat

and then only in a police court, where a
servant girl sued her mistress for wages.
In the old territorial days women were
jurors in criminal cases quite often.

Emporia, Kas., Aug. 25.—The three
Chinamen in Emporia are greatly agi
tated and one of them is scared nearly
to death by the arrival here of an agent
of the Highbinders named Lee Kee,
who hails from New York. He had de
livered a message to Wuong Lee com
manding him to leave here immediately
or prepare to die.
Three years ago Wuong sold his laun
dry here to two Chinamen named Lee
Serve Kel and Lee Bon Kee, both of
whom are, it seems, members of the
Highbinder Society. About three months
ago Wuong returned to the city and

To Test a Railroad Law,
Columbus, O., Ang. 26.—The Wabash
Railroad company has served notice on
Attorney General Richards that the]
case of Ashley and others against Hon
Daniel J. Ryan will be carried to thi
United States supreme court. This it
the case involving the constitutionality
of the Massie incorporation fee law, n»
der whioh the Wabash was compelled
to pay about $85,000 to the state when
its lines were consolidated. The money
was paid under protect, hs waa that of
the Big Four, Pan Handle and other
lines. The supreme court of this atata
recently declared the law constitutional,
but the company is not satisfied with
the result.
