‘Woman Physician Is ‘
Ordered to Trial For
Highball Murder
(Continued From Page One) ’
was administered to Dr. Kennedy |
lasy July during a midnight. visit
he made to the residence of Dr.
Dean. |
For five days, the physician said |
he a'tempted to tréat himself, but |
failing in “this, he reported his |
condition to close friends and was !
taken t, Jacksbn for treatment
where he died on August 6. {
it is the contention of the prose- |
cution that Dr. Kennedy made a|
dving declaration to his two broth- |
ers, Dr. Henry Kennedy and Dr. |
Barney Kennedy, alleging tg them |
that Dr. Dean served him a poison |
highball. |
The defense in discussing the |
case denies the charge and con~'
tends that if there was poison it |
could have occurred from other |
sources. ; : |
They sought to inépect the hos~l
pital records to determine whéther |
Dr. Kennedy was administered |
opiates that might have 'afle’ctod[
his mind in his dying condition,
but a state statute barred the rec- |
ords from review under a “privi-|
leged” provision. : ’
Mr. Jordan said the entire week |
had heen set aside for hearing the |
case and that the state had about |
twelve witnesses to call.
Up to Monday only 166 oy the
200 veniremen summoned had been |
served and court attaches'zpecu—l
lated that some of them would!
have to be excused for non-pay
ment of taxes which is required of
jurors under the law.
Defense counsél were said to
have in their possession a batch of
letters in which Dr. Kennedy ex
pressed his admiration for the{
