THE WINDER NEWS
Robbing Graves Is
Unlawful in Georgia
Sam Ware, negro undertaker who
was recently convicted in the Fulton
courts on a charge of grave robbing,
and sentenced to 10 years in the state
prison, was granted anew trial by the
Georgia court of Appeals on Tuesday
and, at the same time, it was indicat
ed that under the Georgia law. Ware
lias eomndtteed no criminal offense.
In reversing the decision of tile low
er court, which overruled the motion
for anew trial, the court of appeals
points out that the indictment charged
that the body in question, was “remov
ed from its grave and place of inter
ment.” The court points out that this
was not done. Instead the testimony
showed, without rebuttal, that the body
was not removed from the grave, but
that the lid of the plain wooden box,
which held the casket and the body,
was lifted, the body lifted up in the box,
the casket slipped out from under it,
and the body laid hack in the box. The
lid was then replaced and the dirt
shoveled back in the grave.
The court points out that the lifting
of the body is not covered by the stat
utes, which makes “removal” of a body
a criminal offense. If concludes the
decision by stating that the act as per
formed by Ware, according to the un
controverted testimony it the trial, is
no crime under the present law, hut
brands it as goulisb and horrible, and
urges the lawmakers of the state to
remedy the defect.

NEGROES BURIED
IN POTTERS FIELD
So many friendless and unknown
Southern negroes have died, been tak
en to the morgue, and failing identifi
cation have been buried in the potters
field at Detroit that civic authorities,
together with negro mnisters are tak
ing steps to provide every emigrant
Southern negro with an identification
card, giving the address of his nearest
Southern relatives, or “white folks.’’
Seventy-five per cent of the uniden
tified dead in the Detroit morgue are
negroes, according to the Detroit News,
and the majority of these are newly ar
r*vcfi from the South. Tuberculosis, ty
phoid, and in some 6ases actual starve
non, are responsive for the majority
of deaths, although a surprisingly large
number of killings occur when the ne
gro competes with the low grade im
migrant, and race clashes between the
negro and the immigrant classes are
becoming more and more frequent.
