This 6 day of Sept. 1909. J. H. Ham, Ordinary. APPLICATION FOR CHARTER Georgia Butts County: TO THE SUPERIOR COURT OF SAID COUNTY The petition of C. A. Pittman and S. T. Moore, both of said county and State, respectfully shows: 1. That they desire for themselves, their associates, successors and assigns to be incorporated and made a body pol itic under the name and style of Pitt man’s Ferry for a period of twenty years. 2. The principal office of said com pany shall be in said County of Butts, State of Georgia. 3. The object of said corporation is pecuniary gain to itself and sharehol ders. 4. Thebusinesstobecarriedon by said corporation is to operate a public ferry located on the Ocmulgee river in the county of Butts and Btate of Georgia, where the public road leading from Stark, Ga. to Monticello Ga. knowm as the old Pittman’s Ferry, crosses said river. Petitioners desire the right to transport for hire across said river on said Pittman’s Ferry passengers, hors es, mules, and animals of all kinds, also all kinds of vehicles or anything of value, that may be transportable on said ferry, and to charge a reasonable hire for same, and that in case of high water, or at night that thev be allow ed to charge a higher rate for said transportation than in day time or dur ing low water. 5. That the capital stock of said corporation shall be Ten Thousand Dol lars with the privilege of increasing said sum to fifty thousand dollars at any time that they may desire, ten per cent of the amount of capital to i>e em ployed by them has been actually paid! in. 6. Petitioners desire the right to sue and be sued, to plead and lie im pleaded, to have and use a common seal, to make all necessary by-laws and regulations, and to do ail other tilings that may lie necessary for the success ful carrying on of said business, inclu ding the right to buy, hold, and sell real estate and personal property suita ble to the purjmse of the eorjioration, and to execute notes and bonds as evi idenee of indebtedness incurred, or which may lie incurred, in the conduct of the affairs of the corporation and to secure the same by mortgage, security deed, or other form of lien, under ex isting laws. . 7. They desire for said corpoation the power and authority to apply for and accept amendments to its charter of either form or substance. They also ask authority for said corporation to wind up its affairs, liquidate andvdis continue its business at any time it may determine to do so by complying with the laws made and provided in such matters. 8. They desire for said corporation the right of renewal of its charter when so provided by the laws of Geor gia, and that it have all such other rights, powers, privileges and immu nities as are incident.to like corpora tions or permissible under the laws of Georgia. 9. That in case of high water on said river, or from any other cause in the judgment of the manager, owner, or proprietor of said corporation it shall tie dangerous to ferry, or transport, across said riser, and any passenger, or any other party shall insist that any person, or any thing of value to be so transported across said river, then and in that event, any loss shall occur to any such person or property, the nuuv ager, owners or proprietor, shall not be liable for any such damage or loss, or if any person shall insist on having transported across said river on said ferry any wild horse or mule, or other animal, when in the judgment of said managers, owners or proprietors, and if any loss or damage shall occur to said property, then and in that event the managers or owners shall not be liable for such loss or damage. 10. That they be allowed to use at said ferry for the purpose of transpor tation, or other use, flats, row boats, gasoline boats, steam boats, or other means of transportation that may seem best to said corporation. 11. That they be allowed to fix the hire or rates for the transportation on said ferry across said river, of passengers, vehicles of all kinds, and of any other thing of value, that may be carried to said ferry for the purpose of transpor tation, said rates to be fixed at a rea sonable amount, in each case. Wherefore, petitioners pray to lie in corporated under the name and style aforesaid with the powers, privileges and immunities herein set forth, and asare now, orinay hereafter lie, allowed a corporation of similar character un der the laws of Georgia. Mr. and Mrs. Croff Maddox of Flovilla, spent last Sunday with Mr. and Mrs. W. A. White. Mr. and Mrs. Troy McClure, and little daughter, Mr. and Mrs. Walter Jones, and Miss Carrie Biles were guests of Mr. and Mrs. Hope McClure Sunday. Miss Fannie Lou Wyatt, an attractive young lady who is visiting Mrs. G. W. Wyatt will return to her home in Atlanta next Sunday. The many friends of Mrs. Ad eline Dodson and Mrs. Martha Moore will regret to learn that they are on the sick list this week. Mr. Lee Giles of Orlando, Fla., died on the sth inst. Mr. Giles I was well known around here, his ! old home, and the news of his sudden death was a shock to his relatives and friends. Misses Mae and Maude Duke were shopping in Jackson Mon day. Dr. and Mrs. Harper returned home from Borden-Wheeler Springs Saturday where they have been for Dr. Harper’s health. His friends will be glad to know that he is much im proved. Mr. Emory Harper who was taken with an attack of acute indigestion last week, continues quite ill. The remains of Mr. Ben Rick erson were brought up from South Georgia Sunday evening and incerred at Macedonia ceme tery Sunday night. Mr. Ricker son once lived at Stark. Misses Annie, Vera and Jessie Jones of Jackson spent Sunday with their aunt, Mrs. Stella O’Neal. CARD OF THANKS.
