ORDINANCE CREATING
BUTTS COUNTY-JACKSON
RECREATION COMMISSION
WHEREAS, the governing
bodies of Butts County and the
City of Jackson are mutually in
terested in an adequate program
of community recreation under
the auspices of Butts County-
Jackson Recreation Department,
and
WHEREAS, the legal vehicle
for creation of such a depart
ment has been provided by the
General Assembly of the State of
Georgia in the passage of the
Georgia Recreation Enabling
Law, passed February 1, 1946,
and amended from time to time
subsequent thereto, and
WHEREAS, the County of
Butts and City of Jackson
through their respective govern
ing bodies desire to conform to
the requirements of said law and
take advantages of same, all in
the interest of providing the best
recreation program for the citi
zens and youth of Butts County
and the City of Jackson with the
least possible expenditure of
public funds.
NOW, THEREFORE, pursuant
to the aforesaid Georgia Recre
ation Enabling Law,
BE IT RESOLVED AND OR
DAINED BY the County Com
mission of Butts County,
Georgia, in official session and
the City Council of the City of
Jackson in official session:
1.
Under the provisions of the
Georgia Recreation Enabling
Law, approved February 1, 1946
(Georgia Laws 1946, Page 162)
and amended in 1953, 1964 and
1971, there is hereby established
the Butts County - Jackson Rec
reation Commission. This shall be
a joint body representative of
Butts County and the City of
Jackson. It shall consist of an
odd number of members and not
less than five (5) or more than
nine (9), with the County and
the City having the authority to
individually and exclusively name
an equal number of said mem
bers and the County and City
by joint agreement to name the
remaining member.
2.
The terms of office shall be
five (5) years or until their suc
cessors are appointed and quali
fied, except that the members
first appointed shall be appointed
for such terms that the term of
one member shall expire annually
thereafter. Vacancies occurring
other than by expiration of term
shall be filled by another appoint
ment for the unexpired term, and
the governing authority making
the initial appointment shall have
the authority to make the ap
pointment for the unexpired term
in accordance with the foregoing
procedures.

The following named persons
are hereby appointed effective
the 21st day of August, 1972, as
members of the Butts County-
Jackson Recreation Commission
for terms as so indicated.

Immediately after their ap
pointment, the members shall
meet and organize by electing
one of same Chairman and
such other officers as may be
necessary. The Commission shall
have power to adopt Bylaws,
rules and regulations for the
proper conduct of recreation for
the County of Butts and City
of Jackson.
5.
The Recreation Commission
shall provide, conduct, and super
vise public playgrounds, ball
fields, indoor recreation centers,
and other recreation facilities
owned or controlled by said Com
mission.
6.
The Recreation Commission
shall have the power to appoint
or designate someone to act as
Executive Officer who is trained
or properly qualified for the
work, and such other personnel
as the Commission deems proper.
7.
Annually, th e Recreation Com
mission shall submit a budget
to the County Commission of
Butts County and the City Coun
cil of the City of Jackson for
their approval. In addition to the
funds appropriated by the gov
erning bodies, the Commission
may accept any grant or devise
of real estate or any gift or be
quest of money or other personal
property or any donation to the
applied principal or income, for
either temporary or permanent
use for playgrounds or recreation
purposes, but if the acceptance
thereof for such purposes will
subject the governing body to
additional expense for improve
ments, maintenance, or renewal,
the acceptance of any grant or
devise of real estate shall be
subject to the approval of the
governing bodies. Money received
for such purposes, unless other
wise provided by the terms of
the gift or bequest, shall be de
posited in the funds of the Rec
reation Commission. The Commis
sion may also charge a nominal
fee for a variety of activities
which may not be included in the
original budget request.
All monies received by appro
priation or otherwise shall be de
posited to the account of the
Recreation Commission. The Com
mission shall make an account
ing to both governing bodies at
the conclusion of every fiscal
year.
8.
The Recreation Commission
shall make an annual report to
Butts County and the City of
Jackson and such other reports
as from time to time may be re
quested.
9.
All ordinances, resolutions, or
parts thereof, in conflict with the
provisions and intent of this or
dinance/resolution are hereby re
pealed.

POWER IN DEED TO
SECURE DEBT
On the 28th day of August,
1963, ROBERT LEE JOHNSON
executed a real estate promissory
note for the principal sum of
FOUR THOUSAND & 00/100
($4,000.00) DOLLARS to NEW
TON FEDERAL SAVINGS &
LOAN ASSOCIATION of Coving
ton, Georgia, which note with in
terest thereon at the rate of six
and one-half (6%) per centum,
per annum, was payable in
monthly installments of $34.85
each, beginning on the first day
of December, 1963, and continu
ing thereafter on the same day
of each succeeding month, with
the final and last installment be
ing due and payable on the first
day of November, 1978, each pay
ment being applied to the inter
est then due, and the balance
to the reduction of the principal
amount, the interest being com
puted on the unpaid principal.
Time was made the essence of the
contract, and the said note con
tained a provision for the pay
ment of ten (10%) per cent of
the unpaid principal and interest
as attorney’s fees, if collected
by law, or through an Attorney
at Law. In order to secure the
payment of said note, the said
ROBERT LEE JOHNSON execu
ted and delivered to NEWTON
FEDERAL SAVINGS & LOAN
ASSOCIATION a Deed to Secure
Debt, conveying to it the follow
ing described tract of land, to
wit:
“All that tract or parcel of
land, situated, lying and being in
the 612th District, G. M., Butts
County, City of Jackson, Georgia,
fronting North on Buchanan
Street Seventy-five (75) feet and
particularly described, to-wit:
BEGINNING at a point 455
feet east of the southeast corner
of the junction of Buchanan
Street with Alta Viston Street,
thence 100 feet south to a point;
thence West 75 feet to a point;
thence North 100 feet to a point
on the south side of Buchanan
Street; thence east along the
south side of Buchanan Street
75 feet to a point, which is the
POINT OF BEGINNING.
Said property fronting North
on Buchanan Street 75 feet and
extending back South in that uni
form width 100 feet and being
bounded now or formerly as fol

property of James Buchanan.
Said Deed to Secure Debt is
recorded in Deed Book 28, Page
541, in the office of the Clerk
of the Superior Court of Butts
County, Georgia.
Because said ROBERT LEE
JOHNSON defaulted in making
payment of the monthly install
ments as they matured, NEW
TON FEDERAL SAVINGS &
LOAN ASSOCIATION, pursuant
to the provisions of said promis
sory Note and Security Deed
aforesaid securing the same, has
exercised its option and declared
the entire balance due and col
lectible. Notice fixing the liability
for attorney’s fees has been
given according to law. There is
a balance as of the 30th day of
September, 1972, of $2665.42,
besides interest, and attorney’s
fees thereon.
The said Deed contains a pow
er of sale authorizing the Gran
tee as Attorney-in-fact for Gran
tor therein to sell the property
conveyed thereby in order to sat
isfy said Note, as well as sub
sequent advances, after advertis
ing the same once a week for
four (4) weeks in the official
gazette of said County of Butts,
and in accordance with said

cribed above at public outcry to
the highest bidder for cash, on
the first Tuesday in October,
1972, before the Butts County

The proceeds of the sale will
b e used as follows: (1) To pay
the expenses of the sale; (2) To
pay the sums secured by said Se
curity Deed; and, (3) The bal

real estate promissory note for

Georgia, which note with interest
thereon at th e rate of Six and
‘one-half (6*/fe) per centum, per

installments of $41.97 each, be
ginning on the first day of Feb
ruary, 1966, and continuing
thereafter on the same day of
each succeeding month, with the
final and last installment being
due and payable on the first day
of January, 1986, each payment
being applied to the interest then
due, and the balance to the re
duction of the principal amount,
the interest being computed on
the unpaid principal. Time was
made the essence of the contract,
and the said note contained a

asphalt pavement of State High
way No. 16 on the South side
thereof at the junction of East
Street with said Highway, thence
southerly along the west side of
East Street Six Hundred Forty-
Seven (647) feet to a point,
which is the POINT OF BEGIN
NING, and said Point being
One Hundred Twenty (120) feet
south of the northeast corner of
the lot of Lußuth Smith; thence
from said POINT OF BEGIN
NING South along the West side
of East Street 60 feet to a point;
thence West 80 feet to a point;
thence north 60 feet to a point;
thence East 80 feet to a point,
which is the POINT OF BEGIN
NING.
Said described tract or parcel
of land being bounded, to-wit:
North by property of A. C. Free
man & Son; East by East Street;
South and West by property of
A. C. Freeman & Son.
Said Deed to Secure Debt is
recorded in Deed Book 29, page
344, in the office of the Clerk
of the Superior Court of Butts
County, Georgia.

Died At
Decatur Home
Mrs. Kate N. Alston, 96, moth
er of Mrs. E. W. Gibson of Lake
Jackson, Monticello, died Aug
ust 16th at Moody Nursing Home,
Decatur. Funeral services were
held at Glenwood Chapel with
Horis Ward Funeral Home of De
catur in charge. Burial was in
the Gibson Cemetery near Social
Circle.
Mrs. Alston is survived by a
daughter, Mrs. E. W. Gibson of
Monticello, and a son, N. C. Al
ston of Atlanta; seven grandchil
dren including N. D. Gibson and
Mrs. Katie Kilby, both of Lake
Jackson, Monticello.
Mrs. Alston made her home
with her daughter until two and
one-half years ago.

Wendy Elliott visited their grand
daughter and niece, Mrs. Melinda
Mock, at Emory Hospital Sunday.
Miss Susan Rushing and Miss
Pam Johnson of Warner Robins
spent Friday night with Susan’s
grandmother, Mrs. Ira Cawthon
and attended the Jackson-Henry
County football game.
Weekend guests of Mr. and
Mrs. J. F. Johnson were Mr. and
Mrs. W. H. Bradford of Atlanta.
Joining them for Sunday dinner
were Mr. and Mrs. J. M. Eason
of Tucker.
Mr. and Mrs. Clyde Norris, Mr.
and Mrs. J. D. Willard and Mr.
and Mrs. J. O. King spent several
days last week in the Tennessee
and Virginia mountains.
Mr. and Mrs. Naamon York
attended a barebcue Saturday,
Sept. 19th, at College Park given
by Pipe Coap Service Cos. where
Mr. York is employed.
