MISPLACED TRUST
Back through the history
of our nation, people in many
locales have managed to lead
orderly and productive lives
while holding to the tradition
that a man is as good as his
word. While this speaks com
mendably of our heritage,
such trust is hazardous when
buying a home in the cur
rent real estate market. An
actual situation that recently
developed in Michigan will
illustrate.
In this instance, a real
estate man solicited business
by offering higher-than-ordi
nary return on money in
vested with him. This particu-
lar business
man included
church news
paper advertis
ing among his
p romotional
methods -and
he sometimes
responded to inquiries in per
son, carrying a bible.
Numerous real estate trans
actions were handled through
the office of this man before
it was discovered that he was
dishonest. By the time his
misdeeds became known to
others, he was responsible for
a number of acts involving
forged documents, misapplied
funds, and false representa
tions that threatened his
clients with thousands of dol
lars in losses. Subsequently,
he was brought to trial and
was sentenced to prison for
fraud.
Among those facing eco
nomic tragedy as a result
of this unfortunate situation
were real estate purchasers
and lenders that had acquired
title insurance before com
pleting their respective trans
actions. The insuring title
companies paid related losses
in accordance with their poli
cies to protect the insured.
Needless to say, misplaced
trust can be costly when buy
ing & home. And, the pre
viously-mentioned fraud is
just one of many types of
land title hazards that can
trouble real estate investors.
