THE DISCOMFITURE OF the
Attorney General of the United
States in getting caught in his own
judicial bear trap is ironically
amusing to those of us who have
been trying to warn him and the
nation of the dangers it poses since
he first set it out and baited it
with the school segregation decision
on May 17, 1954.

tioned, they obviously have civil
rights cases in piind, too.
The inconsistency of Mr.
Brownell’s position has not been
lost upon the members of Congress.
While there is great sentiment for
protecting the integrity of govern
ment files and preventing defense
lawyen from indulging in fishing
expeditions in them, the general
reaction has been much broader.

AN IMMEDIATE RESULT has
been the creation of a Special Sub
committee of the House Judiciary
Committee to study the effects of
the Court’s recent decisions per
taining to the power of Congress to
investigate, federal laws dealing
with subversion and the enforce
ment of federal criminal laws and
to recommend needed corrective
legislation. While limited in its
scope, this study nevertheless rep
resents an important first step to
ward ending judicial legislation and
curbing the increasingly-flagrant en
croachments of the Supreme Court
Under such circumstances, it is
hard to resist saying, "1 told yau
so" and it is unfortunate that some
one else’s ox had to be gored in
order to bring the hard truth home
to those who adhere to the philoso
phy that the "end justifies the
means." However, the source of
true satisfaction lies not in smug
rejoinders but rather in working all
the harder to restore and revitalise
constitutional government as es
tablished for us and our posterity
by our wise founding fathers.
