WHEREAS, heretofore on the
20‘h day of January, 1961, Dewey
Dien Todd and Annie Melsa Todd
did execute to Bevis Shell Homes,
Inc. a deed to secure debt to the
following described property, to
wit:
All that tract or parcel of land
lying and being in the 1393 Dis
trict GM. of Brantley County,
Georgia, containing one acre,
more or less, of lot of land No.
278, and bounded as follows: on
the north by right of way of the
A. C. L. Railroad; on the east and
south by B. G. Middleton, Estate;
and on the west by lands of Louis
Prescott. This is the same proper
ty described in deed from Bertha
Tabb to Dewey O. Todd dated
March, 1958, and recorded in
Deed Book 19 page 310, Brantley
County, Georgia, Records, to
which reference is hereby parti
cularly made.
To secure an indebtness eviden
ced by a promissory note dated
January 20th, 1961, for $2,700.00,
all as shown by deed to secure
debt recorded in the office of the
Clerk of the Superior Court of
Brantley County, Georgia in Deed
Book 47 page 312-3, and
WHEREAS, on the 30th day of
January, 1961, Bevis Shell Homes,
Inc. did assign and convey the
aforementioned indebtness, note
and deed to secure debt to B. &
P. Inc. as shown in assignment
United States District Judge for
the United States District Court
recorded in Deed Book 48 page
210, Brantley County, Georgia.

WHEREAS, Joseph P. Lieb,
of the Southern District of
Florida, Tampa Division, did in
the matter of Bevis Shell Homes,
Inc., B. & P. Inc. and B. & P.
Insurers, Inc., debtors in proceed
ings for reorganization of a corpo
ration, No. 4204 BKYT, after the
debtors had filed petition for
corporate reorganization under
Chapter X of the Bankruptcy Act,
approve said petition and appoint
John P. Corcoran, Jr., Trustee in
said matter, on he 28th day of
June, 1962, as shown in certified
copy of said order, recorded in
the office of the Clerk of the
Superior Court of Brantley Coun
ty, Georgia in Book of Minutes
4 page 25-6, to which reference is
hereby particularly made; and
WHEREAS, the said grantors
have failed to pay the therein
mentioned indebtness in accord
ance with the terms agreed upon,
the undersigned has elected to
call the entire amount at once
due and payable.
NOW, THEREFORE, according
to the terms of said deed to se
cure debt and the laws in such
cases made and provided, the un
dersigned will expose for sale to
the highest and best bidder for
cash, the above described proper
ty, after public advertisement on
the first Tuesday in September
(September 4th), 1962, between
the legal hours of sale at the
courthouse in Brantley County,
Georgia.
Reference may be made to re
cord of said deed to secure debt
for terms and provisions thereof.
Said sale is subject to all out
standing taxes.
Upon completion of this sale,
undersigned will execute convey
ance to purchaser by virtue of the
power of attorney in said deed to
secure debt.
The proceeds from said sale
will be used first to the payment
of said note and indebtness, prin
cipal, interest, expenses including
attorney fees and any other in
debtness of grantors to John P.
Corcoran, Jr., Trustee in the
matter of Bevis Shell Homes, Inc.,
B. & P. Inc. and B. & P. Insurers,
Inc., as aforesaid, and the balance,
if any, delivered to Dewey Olen
Todd and Annie Melsa Todd, or
party legally entitled thereto.
