Superior Court Judge Ben
A. Hodges said yesterday he
has received no information
indicating that the^jury com
missioners in Brantley Coun
ty have conducted themselves
in any way other than a prop
er manner.
But Judge Hodges com
menting on a newspaper story
in which a former Brantley
official charged irregularities
in the grand jury structure,
said he would be glad to dis
cuss the matter with former
Tax Assessor Raymond Smith
or anyone else.
Smith complained of impro
per jury procedures and cor
ruption in the Brantley Coun
ty government in a letter to
Gov. Maddox. The governor
said he had no authority to
act and suggested he take the
matter up with Judge Hodges
and the jury panel.
The Brantley man said he
talked with Judge Hodges
several months ago.
The Waycross Judicial Cir
cuit Judge said it was possible
that he talked with Smith but
he did not recall specifically
having done so.

Received No Charge About
Brantley Jury,
with many people from time to
time about the jury system
and how jurors are selected.
The Jurist said it is his
responsibility to appoint jury
commissioners and that he
does so independently of any
political factors or groups,
making every effort to select
reputable and capable citizens
for this duty.
But he pointed out that the
disqualification of jurors, as
provided by Georgia law, can
be only for conviction of
crimes involving moral turpi
tude or for non-residence in
the County.
Judge Hodges noted that
Smith charged in the newspa
per story that a member of a
recent Brantley County Grand
Jury served on the panel while
on bond from a breaking and
entering charge in Florida.
He said the jury commis
sioners probably were not a
ware of this action and that,
in any event, since the case
had not been adjudicated at
the time, they had no authori
ty to remove the name from
the jury list.
“There is no authority un
der the law to take judicial
cognizance of the fact that a

crime,” the judge explained.
“Even if I had known about
this man I could not have
withheld his name from the
jury list,”
Judge Hodges said Smith
and others have legal resource
if they believe grand jurors
are ineligible. He said they
can challenge the selection in
court and on appeal to the ap
pellate courts.
He noted that the law does
not make the judge a super
visor of the jury commission
ers but simply requires that
the commissioners be famil
iar with the law.
The judge said he has in
structed county attorneys in his
circuit to read the law apply
ing to their duties periodically
to all jury commissioners.
He said he knows of no jury
who has not followed the law
to the letter but if there are
complaints they should be
brought into court in the prop
er manner and not made in
the newspapers.
If irregularities are shown
in the grand jury procedure
“I will take care of them
myself,” Judge Hodges said.

application for compensation
with the VA. Upon comple
tion of processing, you will
be informed of your VA en
titlement, and given an op

whichever of the benfits is
greater. You may re-elect these
benefits as often as it is to
your advantage.
Q — I am a disabled veteran
and received 50 percent dis
ability compensation for my
self, wife and two children.
One of my children will be 18
years old four months from
now. Will I continue to receive
benefits for him?
A— Not unless he plans to
continue in school. Three
months before your son’s 18th
birthday, the Veterans Admin
istration will send you notice
of discontinuance of benefits
for him. However, VA will al
so send at that time an appli
cation to be filled out if he
plans to continue in school.
You will continue to receive
benefits for him until
he reaches 23, if he remains
in school and is unmarried.

Alleged Corruption Up to Courts, Says Maddox

NAHUNTA — A former
Brantley County tax assessor
who asked Gov. Lester Mad
dox to conduct an investiga
tion into the grand jury struc
ture here and to check into
alleged corruption in the coun
ty, has told the Morning News
that he is “distressed that the
governor does not have the
power to help.”
Raymond Smith said he re
ceived a reply from Maddox
stating that “there is abso
lutely nothing that I, as gov
ernor, can do to remedy the
situation.”
Suggestion Made
Smith said Maddox suggest
ed that he turn any informa
tion in his possession over to
Judge Ben A. Hodges, Superi
or Court Judge of the Way
cross Circuit, and to the
Brantley jury revisors.

vary community held their
regular monthly meeting on
Tuesday, April 14.
The meeting was held at
the home of Mrs. Joyce, who
along with Miss Pauline Jack
son, served as hostesses.
The program for the meet
ing was on fly control and
pesticide safety. The speaker
was Mr. Howard Davis, who
works with the State Depart
ment of Agriculture. Mr. Da
vis gave a very interesting
slide presentation on the sub
ject of consumer protection by
the Georgia Department of
Agriculture. He also present
ed slides on fly control and
pesticide safety.

UNABLE TO ACT IN BRANTLEY
months ago and recently with
a member of the jury revi
sors and received little en
couragement.
Gov. Maddox, in his letter
to Smith, stated that he would
meet with Smith, by appoint
ment, if he desired.
“I feel disappointed that the
governor has no authority to
help in this serious matter. I
feel that something must be
done soon in order to save
the county for the people.
“The Governor has been
outspoken concerning
wrongdoings in other counties,
but we seem to have no re
course here,” Smith said.
In a letter to Gov. Maddox,
Smith, manager of the Brant
ley County Airport, claimed
that some members of the
grand jury are apparently
serving illegally and some, he
says, have been involved in
crimes ranging from public
drunkeness to selling liquor
on Sundays.
He has charged that a mem
ber of the recent grand jury
served on the panel while on
bond from a breaking and en
tering charge in Florida and
is now in a Florida prison, ac
cording to Smith.
Smith, in his letter, told the
governor that recent grand
jurors have failed to indict
persons accused of selling al
coholic beverages on Sundays,
and selling intoxicants to mi
nors.
“This affects the lives of
our citizens and the welfare
of our children,” Smith wrote,
“and while I do not condemn
the entire grand jury list, I
feel that inactivity by the

les N. Dobbins, veterinarian
with the University of Geor
gia Cooperative Extension
Service, has for Georgia swine
producers. Dobbins says pro
ducers should keep .alert to
hog cholera symptoms and
contact the local veterinarian
if symptoms are noticed.

panel and the absence of nam
es of many prominent citizens
from the jury list is evidence
enough to merit an investiga
tion.”
Smith said his own name
was removed from the jury list
after he attempted to expose
a car tag selling racket which
he says cost Brantley County
taxpayers thousands of dollars.
“I have in my possession e
vidence that the tag racket
did exist and out-of-state resi
dents purchased Georgia li
cense plates in Brantley Coun
ty and never paid taxes here
on the vehicles for which the
tags were bought.
“I was removed as a pro
spective juror after trying to
expose this racket. This leads
me to believe that you must
not try to expose corruption
if you want to serve on the
Brantley County grand jury,”
Smith said.
Hits System
He said that Brantley Coun
ty has over 3,000 registered
voters of which over 800 serve
as petit jurors and some 270
serve as grand jurors. He said
two-fifths of the registered vo
ters are eligible to serve but
many outstanding citizens are
being denied the right.
Smith mailed a copy of the
grand jury list to Maddox as
placed in the jury box on Aug.
4, last year. Beside the names
of some he made notations
for alleged prior arrests, con
victions, and other charges.
According to Smith’s nota
tions, two persons on the jury
list had been indicted for cat
tle theft; several had been ar
rested for speeding and drun-

ken driving charges; several
had been involved in assaults;
one was convicted of fraud;
one was arrested for hauling
moonshine; and one was fined
for violating state game and
fish laws.
Smith served as county tax
assessor for four years of a
six year term. He resigned on
Jan. 6 because of what he
termed pressure and harrass
ment.
Smith told the Morning
News that a delegation of
concerned Brantley Countians
hope to meet with Gov. Mad
dox to “further discuss the
problem.”
