Os Discharges
Atlanta — A veteran who
has been discharged from
military service because of
using drugs may now ask for a
reconsideration of the condi
tions of his discharge accor
ding to Georgia Veterans Ser
vice Director Pete Wheeler.
Actually, the possibility of
changing a discharge classifi
cation is not limited to drug
users, but there has been an
upsurge in the process of re
viewing discharges in recent
months because of the Vet
erans Administration’s activi
ty in providing medical treat
ment for drug-users. The VA
is barred, by law, from
treating veterans with dis
honorable discharges.
Wheeler said that a veteran
whose discharge is “some
thing less than honorable”
may be able to secure a re
view of his discharge.
“Each branch of the ser
vice has established a Dis
charge Review Board which
is authorized to review appli
cations for change in character
of discharge. The Discharge
Review Board is a permanent
board comprised of high
ranking active duty military
officers, generally five in num
ber.
“This Discharge Review
Board may accept an appeal
for a review of a discharge or
dismissal from service in the
case of any administrative
discharge or any discharge
directed by the sentence of
court-martial, except general
court-martial, and appeal must
be made within 15 years of
the date of release from active
duty.”
Generally speaking, the
prime basis on which an ap
peal may be made is the
existence of “new and mate
rial evidence” in the case.
An applicant has the right to
make a personal appearance
before the Discharge Review
Board in Washington. All ex
penses incurred by such a
personal appearance, however,
must be borne by the appli
cant.
“It is necessary and im
portant,” said Wheeler, “to
support an application for re
view of discharge with any
and all evidence available.”
Any veteran who is con
fronted with such a problem
about his discharge may se
cure more advice and informa
tion from any office of the
Georgia Department of Vet
erans Service.
