PUBLIC NOTICE
CITY OF ROBERTA LAND
DEVELOPMENT REGULATIONS
PROPOSED TEXT AMENDMENTS
AMEND THE
ROBERTA LAND DEVELOPMENT
REGULATIONS TO ALLOW FOR A
DEFINITION OF
“SPECIAL EXCEPTION” AND
“VARIANCE”
These amendments will be added to
ARTICLE II. DEFINITIONS OF TERMS
USED IN THIS RESOLUTION,
SUB-SECTION 2.2. SPECIFIC
DEFINITIONS.
Proposed Definition for “SPECIAL
EXCEPTION” - A Special Exception
is the requirement that a land
owner seek specific permission
from the Board of Commissioners
in order to use a particular parcel
of property in a manner requiring
such Special Exception as reflected
in the various chars and tables
listed throughout the CCLDR. Any
such Special Exception granted
will be void if not acted upon in the
manner described in the request for
such Special Exception within 12
months immediately following its
issuance or if such use ceases for
a period of 12 months following the
commencement of such specifically
authorized use.
Proposed Definition for “VARIANCE”
- A departure from any provision of
this resolution for a specific parcel,
except use, where such variance will
not be contrary to the public interest
and where, owing to conditions
peculiar to the property, and not as a
result of the action of the applicant, a
literal enforcement of this resolution
would result in unnecessary and
undue hardship. The purpose for
which any such variance is granted
must be initiated within 12 months
immediately following issuance of
the variance or same will be void.
