JUDGFS MOT SUSPEND SENTENCE Opinion Rendered By Attorney General Holds They Cannot Interfere After Sentencing A LANT A, Oct. 18.—A judge of the superior court in Georgia has no authority to suspeno the exe cution of a sentence imposed by hnn in a criminal case, except indicental to a review of, the judg ment. under which toe sentence is imposed, Attorney General George M. Napier lias ruled in; an opinion submitted to Governor Clifford Walker. The opinion was given at the rii -1 quest of the governor, who had re k ceived a letter from W. G. Ruling B clerk and attorney pf the board of r commissioners of roads and reven ues of Harris county, relating to the case of Dock Barker. The man was sentenced and later had his sentenced changed by the judge. The county attorney wrote to ask it the judge's order was “sufficient in point of . law to authorize the warden to abide by the terms thereof.” The attorney general held the order was not sufficient in point of law to be complied with. "He was .sentenced by the court to servitude upon the chain gang with the privilege of paying a fine after serving a certain part of the sentence and having the balance suspended.” Three monVis after the sentence was passed an order was received by the board, the let ter continued to release the convict. "1 would regret to hold that a judge of the superior court has ex ceeded his authority in any matter,’ raid the attorney general after cit ing several supreme court deci- Hons to support his ruling. “But it appears from the foregoing deci sions th; t the order of the presid ing judge of Harris superior court, modi l ying the sentence and order ing' release of the convict after he had served a certain portion of the time named in the original sen tence) was ultra-vires, for the rea son that the supreme holds .distinct ly that a sentence of judge in a criminal case cannot be suspended by the judge of the court except incidental to a review of the judg ment under which the sentence was imposed.
