TRIAL BY THIRTEEN JURORS- Hound common serise and prov ed expediency characterize the practice whereby thirteen, instead of the regulation twelve, jurors will hear evidence in the Patrick Calhoun trial m Han Francisco. The Calhoun case is on a plane with many other celebrated trials, civil and criminal, in this coun try, wherein both prosecution and defense were subjected to exaust-, itig uml extraordinary expense in summoning witnesses and employ-' ing counsel. It has transpired frequently in j the past that arduous labors and trenienduous expenditure were alike brought to nothihg by the unexpected illness of onb or more of the jurors. ' Tins contingency, the device adopted in the Calhoun trial, is intended to obviate. Should one j of the con vent ional twelve jurors j become incapacitated for service, j be can retire from the jury box j without prejudice to the onward process of the trial. Had this method been gener ally adopted several years ago, public treasuries would have been saved immense and unnecessary; drains and socitey would have 1 been spared the reproach and oh-1 vious injury that follows delay in I meeting out justice.—Atlanta ( 'ellMtitlltioll. BRYAN TO SPEAK IN FLORIDA HOUSE’ Tallahassee, Fla., Aoril 19. Hon. lon L. This comes as the result of a speech by Congressman Clark in the Florida house defending his action in congress in asaailing the: Nebraskan. GEORGIA ACCEPTS RULING ON FLOUR. Washington, April 19. —Com- missioner T. Q. Hudson, of the Georgia depurment of agriculture, will confer tills afternoon with Secretary of Agriculture Wilson and i>r. Wiley, pure food expert, on the recent order prohibiting, after July 1, the sale of bleached ! . flour. Atlanta, Ga , April 19.—N0 ! more small fines will be imposed | on near-beer dealers convicted in 1 the Atlanta city court for violat ing the prohibition law, according to an edict announced by Judge Andy Calhoun this morning when he placed an assessment of SI,(XXJ on F. P. Whitiey. Whitley was tried on the charge of keeping intoxicating liquors in u public place, the place being bis near-beer saloon, where a raid de veloped the existence of a quanti-j ty,of whisky. He was represented at the trial by T. B. Felder,who declared that it. is Ins purpose to test that fea ture of the prohibition statue, •veil if he has to go to the supreme | court of the United States. “Those near-beer dealers must keep witnin the law,’’ declared Judge Calhoun in placing a fine of SI,OOO or a term of twelve months chaingang service on Wlntley. “After this I intend to I give them the limit of the law.” OFF TO MACON.
