M itch«ll, the Thomas county man. Conclud ing Ins reasons for declining, he saiii: “While the pardoning power conferred upon the executive is j practically unlimited, yet it must he held in mind that it was the manifest intent of those framing the constitution that it should lie exercised in such a manner as would not, impair the confidence of the people in the purity of the fountains of justice, t he courts,or weaken the foundations upon which society is limit. “For the foregoing reasons I am ! forced to the conclusion that the sentence originally passed by the, Thomiisville courts should stand, it lienig readily understood that the authorities charged with the custody of the appellant will pro tect, him in all the reasonable de mands of humanity.'
