TURPENTINE TRUST VERDICT STANDS. / November 30. In affirming the judgment of the circuit court in the ‘'naval stores” case, the United States court of appeals handed down no lengthlv opinion, merely reciting that the coi’ft is of the opinion that there i 9 no error in the record. A possible writ of certiorari is all. that now stands between two of the convicted officers of the American Naval Stores Company, the so-called turpentine trust, and prison terms It is said that application for the writ to have tlie case reviewed by the United States supreme court will be made within the next few davs. This case was tried before Judge Willis B. Sheppard at Savannah. Ga , in May, 1909, the indictment containing three counts charging violation of the Sherman anti-trust law. The re suit of the trial marked the first conviction of .officers of a cor poration under this statute and two of the officers were given jail in addition to heavy Iwiies. Edmund S. Nash, of Savannah, president of the American Naval Stores Company, was fined $3,000; Spencer P. Shotter, chairman of the hoard of directors, $5,000 and three months’ imprisonment; J. F. Cooper Myers, vice president, $2,500 and three months’ im prisonment; George M. Board ina;*, New York, treasurer, $2,000; and Carl Muller, agent, Jackson ville, $5,U00. The secretary, C. J. Deloach, was acquitted. The convicted Dllif-ers were found guilty ou the first and second counts of the in dictment. which charged con spiracy to restrain trade and con spiracy to create a monopoly. Surveys For Improvement. I Dublin, Gu., Nov. 30.—E. 11. Sonant, who has charge of the improvement of the Oconee, Oe tnulgee and Altamuha rivers un ler Col. Dan C. Kingman, ac companied by E. C. Gavin, junior engineer m the Brunswick office, est this morning on an inspection tour of the Oconee river and then ,v>!( go up the Ocmulgee, after spending two days at Dublin. The party is traveling on the ikidaway, and every part of the iver is being examined. Moisant, as president of the International Aviators, who i were to have held a three days’ meet in this city, cancelled their engagement yesterday morning-, - giving as their reason the fact that the air currents generated by Lookout mountain and the surrounding ridges are too treacherous to permit flying. The meet of Monday afternoon was a distinct failure, for altho | three starts wer ? made,'only one flight was exhibited for the crowd, w.hic-h stood impatiently in the cold for three hours in an ticipation of the fulfillment of the original program, which in cluded a trip to ‘Lookout moun tain over the city. Frisbie, in a Curtiss biplane, and Carros, in the Demoiselee, did not rise more than twenty feet from the ground, alighting immediately. Simon in his Bie riot, made a successful flight of some five minutes duration, slightly satisfying the disappoint ment of the crowd. Most of the party has gone to Memphis, where they will give a three days’ meet. Civil papers were served yes terday upon Charles K. Hamil ton and Nat Reyes, Hamilton’s former manager, as a result of a suit for $5,000 for breach of con tract which has been instituted in circuit court against the two men by J. P. Daly, of this city. The suit is the result of Ham ilton’s failing to appear here last April soon after appearing in Nashville, as it is alleged he con tracted with Daly to do. TO FCRTTY CANAL. New Orleans, Nov. 30. — The of fortification of the Panama canal will be a grave one, according to Congressman Washington Gardine of Albion, Washington, who’ arrived here yesterday with members of the house committee of industrial and arts and expositions, who have been on a t rip to the isthmus. ‘‘To make the canal neutral by an agreement with all nations in volves a grave question,”'Rep resentative Gardiner said. ‘‘lts fortification seems necessary. It is a gigantic work and a gigan tic investment and the outcome of the planned fortification is un certain.” GIRL iN TROUSER’S | CARRIES 3SG GUN. Atlanta, Nov. 30. When she was arested near the Piedmont Hotel in the business center of the city for parading in man ’s attire, there was found upon the person of Miss Lela Dean when taken to police headquarters a i large revolver. Her only reason | that she liked man’s clothes bet- J ter in cold weather. She was 1 held both for disorderly conduct : and carrying cancealed weapons. 1 This is her second public appear ance in men’s clothing. SENATOR CLAY’S WILL Atlanta, Nov. 30. The will of 1 the late Senator A. S. Clay has been filed with the ordinary of Cobb county, his home. His estate is estimated to he worth | $65,000 to $75,000 above all lia bilities. IDs property consists very largely of real estate, his home with more than seventy acres in it is in Marietta, and val uable Cobh county farming lands. Under the will his widow is sole beneficiary and executor, and at her death, the property is to he divided among the six children. His estate has increased slightly, it is said, during his term of fourteen years as United States senator. The increase is main ly enhanced value of the prop erty. Fall Scud Oats. Butts County to Use Convicts Jackson, Ga., Nov. 30.—Butts county is preparing to work her convicts during the year 1911. Since the convict lease system : was abolished this county has been letting her convicts out to Spalding county in exchange for work. This has proved unsatis : factory to the people of the coun ty, and beginning January 1, or as soon thereafter as possible, the men will he put to work at j home. Chairman J. O. Gaston, ’of the present board of commis sioners of roads and revenues, which office was abolished at the last session of the general as sembly and the office of one county commissioner established, Mr. Gaston being elected to that i office, is arranging now to work the convicts. He is having a stockade built and getting other i details in readiness. Butts, which has long suffered on account of poor roads, is now arranging to come to the front in the matter of modern road s building. The people of the coun ity are a unit in wanting to see | better highways, and will Wel lcome the convicts hack on the | roads.
