railroad companies) built or connected with, or
placed on, the real estate hereinbefore described,

thereto, and all other lands, standing timber, tim
ber rights and rights-of-way of the company in
the counties, aforesaid, and the earnings, income
and profits thereof;
Excepting, however, all timber which has been
cut and removed and sold, all rights and privileges
which have expired ami all property which has
been lawfully sold, exchanged or otherwise dis

pany or by the receivers thereof appointed by said
court.
PARCEL 11.
All real and personal property of every kind,
character and description and wheresoever situate
not covered by said mortgage of January 2nd,
1912 or by any mortgage supplemental thereto, to
gether with all and singular the rights, privildges,
hereditaments and appurtenances to wit: land,
timber, timber rights, rights-of-way, steel rail
and fastenings, buildings, improvements, ma
chinery, tools, implements, locomotives, log trucks,
Skidders, mules and other live stock, carts, wag
ons, and other logging equipment, logs, lumber
>ard equipment, tenement equipment, office fur
niture and fixtures, capital stock in incorporated
companies, choses in action, supplies ami all and
every other article and thing whatsoever which
the said The Hilton-Dodge Lumber Company and
(or) its said receivers now own or possess or to
which they may 1h» entitled at law or inequity and
which was not covered by said mortgages or any
of them.

Because of the recent creation of
new comities in Georgia some confu
sion may exist in the descriptions as
to the exact location of the property,
hut further particulars can he ob
tained from said pleadings and said
decree and exhibit thereto attached
anil from the deeds therein referred
to by date and hook and page of rec
ord.
Particular Attention is called tothe
fact that some of the timber above
described litis been cut and removed
and that some of the leases, rights-of
-way and other privileges have ex
pired and that some of the property
above described lias been exchanged,
replaced or added to by other prop
erty anil equipment, and the express
intention is hereby declared to sell
the property as a whole as it now
stands and as a going coneei n to be
taken over as of April 1, 1916, inclu
ding everything which the said The
Hllton-Dodge Lumber Company now
owns or has in possession and that
said receivers now own or have in
possession or to which said compa
ny or said receivers may be entitled
at law or in equity, regardless of any
inacuracies and variai ions of descrip
tion, simply separating tlie mort
gaged from tile unmortgaged proper
ty into parcels 1 and II as set forth
i in sit iit decree of Feb, 24, 1916, and
special reference is hereby made to
page 5 of said decree for further par
ticulars as to said parcels I and 11,
respectively.
Each person intending to bid on
parcel I must make a preliminary
deposit of SIO,OOO in casli or by certi
fied check and each person intending
lo bid on parcel 11 must make a like
deposit of s.i,nOil Unless such deposit
is made tlie bid will be disregarded
and sale proceeded with as though
such bid hail not been made. All
moneys or checks so deposited by
cuccessful bidders shall tie on ac
count of purchase price Preliminary
deposits by unsuccessful bidders
shall he returned at the conclusion
of the bidding.
Any and till sales made hereunder
shall he. and are. subject to confirm*
at ion by the court.
Within thirty days after confirma
tion by the court of any hid or sale
of all of said property or either par
cel thereof the successful bidder shall
pay to said commissioners the bal
ance ot purchase money due on his
hid. and upon his failure to do so,
the cash oi cheeks deposited by him
with the commissioners at the time
the property was knocked down to
him shall he forfeited as a penalty
for such failure and shall be applied
toward payment of the expenses of
such sale and toward making any
{deficiency or ins- in case the proper
ty should subsequently he sold for
less than the price bid by him and
toward making good any other loss
occasioned hy such failure.
Should sale not be finally confirm- ■
