Rhode Island Says Prohibition is In¬
vasion Of The States And Of The
Rights Of The People

Washington. Twenty-one states
joined with the federal government in
asking the Supreme court to dismiss
Uie original suit brought by Rhode
Island to test the validity of the pro
hibition amendment to the Constitu¬
tion.
Subscribing to a brief which was
filed by Charles E. Hughes with (he
court’s permission and which asked
dismissal of the Rhode island 'case on
the grounds that justiciable questions
were involved were the states of Del¬
aware, North Carolina, Kentucky, Lou¬
isiana. Indiana. Alabama, Maines, Ar¬
kansas, Michigan, Florida. Oregon,
Kansas, Michigan, Florida, Oivgoir,
Kansas, West Virginia. Nevada. Ne¬
braska. Montana, North Dakota, South
Dakota, Wyoming, Utah and Arizona.
Dismissal of the suit, which the gov¬
ernment has moved, was opposed in
another brief presented by Attorney
Herbert A. Rice of Rhode Island, who
asserted that the government’s view
that the amendment is “unassailable,’'
could “only lead to anarchy and op¬
pression."
Another development in the pro¬
ceedings was indefinite postponement,
by permission of the court, of argu
ments which were to have been heard
soon, in order to permit appeals from
Kentucky and Masachusetts. involv¬
ing llie amendment’s validity, to he
heard at the same time. Assistant At¬
torney General Frierson indicated that
the-arguments might he heard March
fifteenth.
The brief, which was iiied by At
torney General Herbert A. lUci of
Rhode Island, asserts that the govern
ment's view that the amend in- nt is
“unassailable” can “lead to anarchy
and oppression. ” It. ’ contends that

“maintain that line of division be¬
tween-the federal and state powers”
