VoL 91, BILL AGREED 70 BY SENATE k. £, -COMMITTEE AUGUST 28,1‘11;3;;& T Llos AL , T g e : aAct, approved Oc tober 14th, 1879, entitled “an Act :Zfi)_m.“de f'Olj the regulation of Iroad freight and - passenger tariffs In this State; to prevent unjust discriminations and extor tion in the rates charged for the trapsportation of passengers and freights, and to prehibit railroad companies, corporations and !essees in this State from charg ing other just and reasonable rates, and to panish the same, and ‘ prescribe a mode of procedure and ru’les of evidence in relation ! there to; and to appoint commis sioners, and to prescribe their powers and duties in relation to to the same,” the said Act being also incorporated in the Code of Georgia of 1882, and designated in said Code as sections 719 (a) to 719 (p) inclusive; by-repealing section sof said Aet, known as section 719 (¢) of said Code of Georgia; also, by repealing seec tion 6 of said Act, known as sec tion 719 (f) of said Code of Geor gia; also, by amending seetion 12 of said Aet, known as section 719 (1) of said Code of Georgia; and also by ifserting in lieu of said repealed section preseribing the Jurisdiction, powers and duties of the railroad Commissioners, pro viding for appeals from the rul ings and decisions of . said Com missioners, and requiring the various railroad companies doing business in this State to make and publish schedules of just and reascnable rates and tariffs, and for other purposes. -SecrioN 1. Be it enacted by the (teneral Assembly of the State of Georgia, that section 5 of the said Act of Oct. 11, 1879, known in the Code of Georgia of 1832 as see tion 719 (e), which said section prescribes the duties of the Com missioners as to makiug rates of freight and passenger tariffs and rales and regulations to be ob served by all railroad companies doing business in this State be, and the same is hereby repealed, and that hereafter section 5 of said Act and section 719 (e) of said Code shall be as follows: That the Commissioners appoin ted as heretofore provided shall be authorized to make such just and reasonable rules and regula tions as may be necessary for pre venting unjust discrimination in the transportation of freight and passengers on the railroads of this State; and to that end shall be authorized to make such rules and | regulations to designate and flxl ‘the propcrtion of difference in rates of freight and passenger transportation to be allowed for longer and shorter distances on the same or different railroads of this State, and to preseribe what shall be the limits of longer and shorter distances; that they shall be authorized to make just and reasonable rules and regulations to be observed by said railroad companies on said railroals in this State to prevent the giving or paying of any rebate or bonus, directly or indirectly, and from misleading or deceiving the pub lic in any manner as to the real rates charged for freight and pas gangers; and that they shall be authorized to make such just and reasonable rules of procedurs for the hearing and determining of the complaints hereinafter provi ded for as to them shall seem meet and proper: Rrovided, that all such rules and regulations | shall be consistent with the laws of this Stug and of the United States; and provided farther, that nothing in this Act shall be con strued to authorize any inter ference with or regulations of { inter-State commerce. Be it further en asted by the authority aforesaid, That section 6 of the said Act of October 15th, 1879 (f), preserib ing that the Commissioners shall make schedules of rates and de claring the effect of the same as evidence be, and the same is here by repealed, and that hereafter section 6 of said Act and section 719 (f) of said Code of Georgia ghall be as follows: That the several railroad corporations do ing business i this State are here- Dawson, Ga., Thursday, September 10th, 1885. by authorized and required to make edch for. itself, as soon as practicable a scheduls of just and remsonalls . rates | of charges . for ' the t,ransp'})rta,- tion of passengers, freight ‘and cars on the respect!ie tailroads in this State, and said lailroad ¢om panies shall, , from time 4o time, and-as often 4s cir;umstances may require; change and revise sche doles, and when any schxn]e‘ shall have been made or revised as aforesaid, it shall be the Quty of each of said corporations’ re spectively to. canse publication ‘thereof to be made for two sucdces sive weeks in some public news ‘paper published-in-the cities of Atlanta, AngustazAlbany, Sayan nah, Macon, Rome and Columbus, in this State, and after the same shall beso published, it shall be the duty of each of such railroad companies to post at all of the respective stations, in a conspicu ous place, a copy of said schedule to be observed by them for the protection of all persons eoncern ed; and whenever any railroad company doing business in this State, shall make, charge or col lect othet than. just and reason able rates for the transportation of freight or passengers, or shall make unjust diserimination in its charges for freight or passengers, shall give or pay any rebate or bonus in the natire thereof, di rectly or indirectly, or do any act to mislead or deceive the public as the real rates eharged or re. ceived for freight or passage, any person, community, town, city or corporation affected thereby may file with the Commissioners ap pointed under an Act of which this Act is amendatory, a petition in writting, in which the cause or ground of complaint against such railrboad company, and of the wrong or injury to the com plainant shall be plainly and dis tinctly set forth; and upon such petition being filed with said Com missioners, they proceed to hear and determine the same under such just and reasonable rules of procedure as they may have pre scribed for the hearing of such causes in the county in which such cause of complaint originated, or in the county of the prinecipal place of business of such com pany, or in the county of Fulton, and upon the hearing thereof the Commissioners are hereby autho rized and empowered to decide and determine the matters in dis pute, and to make such rules and regulations concerning the same as shall be just and reasonable, and not inconsistent with the laws of this State or of the United States, to be enforced by such proceedings and peralties as are provided in the said Act of Octo }ber 15th, 1879, for a violation of i the rules and regulations provided inud prescribed by said commis sioners; that should either party be dissatisfied with the decision of the Commissioners, or with any vule or regulition wade by them in any case, such party shall ‘ have the right to carry the same by appeal to the Superior Court of the county where the complaint originated, under the same rules and regulations as to supersedeas and manner of appealing as now provided by law in order -cases of appeal from Courts of Ordipary, except that the right to have a supersédeas shall rest in the dis cretion of the Commissioners, or of the Judge of the court before whom the appeal is to be heard, and said Superior Court shall i Le . and determine such case un- Ceor the same rules and regulations as are now prescribed by law for hearing equity cases in said court; that said eauses shall have pre cedence of all other ecauses on the docket, and shall be heard and determined at the first term unless continned for Providential cause, and the party or parties in op position to the railroad company or companies may be represented by the Solicitor-General of the cireuit “in which said caunse is ‘heard; that either party to® such [)r<)coe(ljxlg may move for a new trial, or except to the action and ruling of such Superior Court, in the same manner as' i$ now pro vided by law in other cases; and that the officers of the Superior Court, the Solicitor-General, and the clerk of the Qonwmissiouers, 'parforming services herein pro 'vided for, shall be entitled to the ‘same fees and ¢harges as they are now allowed by law for like ser vices, or such as may be fixed by the Commission or the court,to be paid by the party cast in the pro oeedings in which the said ser vices are rendered, or by either party, in the discretion of the Commissioners or the court, as ‘ now provided by law for taxing costs in equity cases. l ’ SecrioN 3. Be it further enact ed by the authority aforesaid, ‘That section 12 of said Act of Oec t ber 14th, 1879, known in said Code of Georgia as section 719(1), which defines the terms {“railroad corporations,” or “railroad ecom pany,” be, and the same is here by amended by inserting after the word “individuals” the words “re ceiver or receivers,” so that said section, when amended, will read as follows: That the terms “rail rogd corporation,” or “railroad eompany,” as contained in this Act, shall be deemed and and tak en to mean all corporations, com panies or individuals, receiver or receivers now owning or opera ting, or which may hereafter own or operate any railroad, in whole or in part, in this State, and the provisions of this Aect shall apply to all persons, firms and compan iss, and to all associations of per sons, whether incorporated or oth erwise, that shall do busines as comnion carriers upon any of the lines of ralroad in this State (street railways excepted), the same as to railroad corporations hereinbefore mentioned. SecrioN 4. Be it farther enact ed by the authority aforesaid,That no increase of freight or passen ger rates shall go into effect until thirty days after theé beginning of the advertisement required in section 2 of this Act. SecrioN 5. Be it further enact ed by the authority aforesaid,That all laws and parts of laws in con fliet with this Aet be,and the same are hereby repealed. IS GORDON ALIVE?
