took possession thereof, and loaded

pUintiffa property does not affirmatively
appear, bat the presumption is that the
military antboritica diapiaccd it. as the
wagon was found at or near the place
where it was put on the defendant’s cars.
The court charged the jury “ that when
tho carrier seta up tho defense that the
loaa of the property was occasioned by
the public enemies of the State, tho bur
den of proof is upon him to prove by clear
ar.d satisfactory evidence that fact. If
the property was lost, and tho loss waa
occuaionod by the military forces of tho
Confederate States, or by the authority
of the Confederate States, end there eras
no negligence on defendant's part, that
contributed to the loss, it would not lie
liable. If you should find that the prop
erty was rorcivod for shipment by de
fendant, and placed in one of ita cars,and
was token from the cars by the military,
or by tho authority of the Confederate
• States, it was the duty of tin- defendant
to care for the property after it was taken
from the cars, and if it failed to do so in
such reasonable manner os was necessary
and practicable under all the circumstan
ces, and it was lost, the defendant would
las liable.”
Wo find no error in tho charge of the
court in view of tho facts contained in tho
record and os the verdict is right under
tho evidence, wo affirm the judgment of
the court below.

McCat.J.—Whcreadeclarationchargcd
that the defendant had, with force and
nrms and violence, broken the plaintiff’s
dose, and with his feet and 100 head of
cattle trampled upon and damaged his
crop, and the proof showed that defend
ant was the plaintiff's landlord, that he
had undertaken to repair the fence around
tho dose, and in so doing had negligently
taken down tho fence and exposed the
crop to the ingress of cattle; and there
waa some evidence going to show that
plaintiff had consented to the defendant's
going upon the land and making tho re
pain:
Held. There being no count in the
declaration for damages from the negli
gence of the defendant, hut only for the
trespass with force and arms, that it was
error in tho court to charge the jury, that
if defendant tore down the plaintiff's
fence, and cattle got in and destroyed the
crop, tho defendant waa liable for tho
damages.
The effect of the chargo was to exclude
from the jury tho evidence of the plain-
tail's consent to tho repaint of the fence.
If such consent was in fact given, then
tho defendant was only liable for negli
gence, in repairing the fence, whereas
tho charge of tho court makes him liable,
if ho tore down the fence nnd damage re
sulted.

3. When an indictment charges a lar- i
cony from tire house of goods over $50 in
value, nnd there is a verdict of guilty,
and the evidence justifies the jury in
thinking the goods worth over $50, the
verdict ought to stand, notwithstanding
there is some evidence to show- they were
worthless.
4. A verdict of guilty means guilty of
tho charge, as sot forth in the indict
ment.

Tnim, J.—Tho circumstances con
nected with the peri-etration of ’the of
fense charged, as testified by the victim
of the rape—tho degree of resistance on
her part—the fact tliat no alarm or out
cry was made, the place being where it
could have been easily heard—no marks
of violence having been exhibited, and
tho injury Wing concealed for several
days after the opportunity of making
complaint, and no proof of any complaint
ever having Well made except by the
party said to be injured, together with
the fact tliat no legal step was taken
ta punish tho outrage until the
victim's pregnancy was discovered,
make this a case where the crime
charged was not sufficiently proven
under the law to justify a verdict of
guilty.

lly the way of testing the relative skill
of competition in making estimates of the
cropof 1372—'73. a cotton pool was formed
in this city about the first of March last,
and to make it attractive and of impor-‘
tance to all interested in tho cotton bnsi-
and others who desired to enter, an
miry fee of five dollars was charged.
The test was that the person estimating
merest the actual production, or crop in
Ndcs of cotton, for the season of 1872-'73,
as determined l>y tho- Commercial and
Financial Chronicle, of New York, Sep-
torober 1st, 1873, should be entitled to
tho whole amount contributed. The pool
closed on the 16th of March. At that
date a committee of merchant openod the
estimates rocoivod and made a record of
them. Afterwards the estimates and
money received were scaled up and with
tho record deposited in the National Ex
change Bank of Augusta for safe keeping.
As the Lost day of the commercial year
(August 31st) approaches, tlioso concern
ed in the pool begin to feel nn increasing
anxiety, and arc wondering as to what
will W the result. There were about
358 estimates received by the secretary.
Mr. Trotter, up to tho time of closing the
pool. A large majority f those concern
ed are considerably under the mark. The
receipts at the ports unto lust week were
3.008,000 bales, and the receipts of the
week closing last night were 8,536 hales.
Then we have also what has not been
taken into consideration by a majority
probably of those interested, the home
<onsumption and overland shipments,
which are estimated to be 325,000 bales
(a minimum estimate), making a total,
io far, of 3,341,536 bales. The receipts
of to-day and to-morrow will be added to
there figures, hut tho result cannot "offi
cially'' be made known until the Com
mercial and Financial Chronicle paper is
received here, when the estimates will he
unsealed and some one be made the lucky
winner of seventeen hundred dollars, ob
tained by the expenditure of five dollars.
Of tin- total numlicr of estimates made
(358) there are only 25. we learn, who es-
t imated above 3.000,000 hales. Estimates
were received and recordod from South
Carolina, North Carolina, Tennessee,
Louisiana, Alabama and Georgia. There
were twenty-five from Mobile alone.
Mange in Horses.
Wilkes' Spirit of tho Times pronounced
the following to bo a safo and most effect
ive remedy:
Whalo (sperm) oil. six ounces; oil of
tar. three ounces; lac sulphur, two
ounces—mix thoroughly, and apply by
means of a hair brush. The skin should
ho thoroughly washed ltcforo the remedy
is applied. At the end of the second or
third day the animal is again to lie wash -
i-d and the remedy reapplied, as it is very
possible that all the ora (of the mange
insect) are not killed by the first dressing.
Mange being a contagious disease, it is
essential tlmt all animals suffering from
it should lie isolated, and all objects with
which they may liave come in contact

Alarmingr Increase of tlic Na
tional Expenditures.
Tho Tribune says the inconsiderable
monthly reduction of the public debt, and
the heavy sales of gold which the Treas
ury is ftjrccd to make in order to supply
itself with currency, are sure signs that
tho expenditures of tho National Govern
ment hare been carried to on enormous
figure. No wonder tho people look with
disfavor on the recipients of back pay. A
year ago we showed that the expenditures
of tho Government, after deducting the
interest on the debt and premium on
bomls purebred, the army and nary ex- j
penditures, drawbacks of duties and taxes, j
and pension-, had increased from $29.- :

$19,431,027 in 1S71 and $23,326,258 in
1873, which seems a good deal to pay for
the rotting of a few soore old hulks,
adapted for modem warfare only as the
minnow is adapted for the jaws of the
pike.
