A Yiciory for Debs m tbe conspiracy case at
Chicago.
Chicago, Feb. 5.—At the opening of the
Debs tnal today Mr. Walker asked on behalf
of tberoreruuient that tho caaee against Den
nis Larkin, John Darke, i’r*nk braver and
j* McDonald be dismissed. Judge Gross-
cup dismissed these f ur and announced that
ho Would let the jury pass on the eases of the
directors of the American liailway Union.
The defense asked him yesterday to dismiss
the cases without a iurther hearing in regard
to John I. McVoau and Martin J. Elliott, the
least active of tho directors The judge said
ho would take their cases uuder considora-
ation. Tho defense began its case by putting
on the stand President i homas of tho Uiicago
ami Western Indiana railroad. Mr. Thomas
was questioned about tho General Managers
Association. Ho said the association had
considered the q ica iou of reduced wages of
employes of tho roads conterbig in Chicago.
Attorney Darrow put the witness through a
not examination as to tho objects and methods
ot the associations and its action in combining
to defeni the American Railway Union iu the
mg ra:lcoad striko, which was admitted.

should bo admitted, Judge Grosscup said: “I

This ruling is regarded as s distinct victory
for the defeuso.

had read this Attorney Julian Mack said;
"I am prepared to state on information and
belief that that affidavit ia an unmitigated
falsehood."
Judge Orosscup seemed somewhat startled
at this statement, lie dumanded that Mr.
Mack procure affidavits from Now York at
once confirming this statement, and said he
was determined to dx tho rcspousibllity for
the connection of theso two young men with
tho caso.
At tone/ Mack caused another sensation
when lio aecusod attorney Burry, who rop,e-

versation:

This closed the matter until Thursday
