A Lawyer’s Tout Solicits a
Suit Just After an
Amputation.
Singular and Disgraceful Incident at

of His Case.
About eight weeks ago A. B. Garrett
a small grocer, whose place of business
was then at the corner of Woodward ave
nue and Martin street, was knocked
down by a Central Railroad switch-engine
at the Mitchell street crossing and seri
ously mutilated. His right arm was
badly crushed at the elbow, and three of
the fingers of his left hand entirely sev
ered.
He was taken to the Grady Hospital,
where it was found that amputation
of the right arm would be necessary.
Exactly two days after the operation
had been performed he received a visit
from a special bailiff, who is employed by
one of the leading attorneys of the city.
The bailiff got down to business without
much delay, and made Mr. Garrett a
proposition on behalf of his employer to
take the case on a contingent fee of fifty
per cent. Garrett was in straightened
circumstances, his business having been
broken up, and he closed the contract on
the spot. Afterward he asked the bailiff
if it was possible for him to get a small
sum of ready money to pay his expenses
pending the hearing of the case. He was
told that he must see the lawyer in regard
to the matter.
After some weeks Garrett was able to
leave the hospital, and called immediately
on his attorney. He explained his condi
tion and repeated his request for an ad
vance of a small amount of money. The
attorney replied that he was not in the
habit of lending money to his clients and
refused to advance him a cent.
Garrett was desperate, and finally, the
lawyer, who still refused to make the loan
himself, promised to see if it could not be
arranged through a third party. A well
known money-lender was callgd in, and
consented to advance sls a month and a
suit of clothes in consideration of one
third of the amount of money which
should be collected from the railroad.
In the contract which the attorney had
drawn up he stipulated that he was to be
empowered to compromise the suit in any
manner, or for any sum he might see fit.
Garrett refused to sign the new agree
ment and since then has been anxious to
put his suit in the hands of another law
yer. He is regarded as having a “good
case” and there are at least a dozen law
yers in the city who would be glad not
only to take it for nothing, but to make
him a substantial advance. Luckily, an
uncle came to his assistance and kept him
from literally starving.
His story is significant from several
standpoints. In the first place, it shows
the extremely low morale of the Atlanta
bar, in which the disgraceful practice of
touting for cases is commonly practiced,

and it moreover casts a singular side
light upon the management of the Grady
Hospital. That a lawyer’s drummer
should be allowed to solicit business from
a patient two days after a serious surgi
cal operation, looks very like an instance
of “divvy.”
