The Petitioners for Hie Release Reply to
Certain Strictures.
Editors Telegraph and Messenger: We
have noticed with regret two articles in
your paper, ons purporting to be from
Buzzard Roost, the other from Gridin, in
regard to the efforts made to commute the
death sentence of Jack Barrett to life ini-
prisonment. For the cause of the doomed
man we deemed it proper to pass unnoticed
these Articles until after the Governor
should have acted upon the application. A
strong eflort has been made to save his
life, but while we are writing this article
the unfortunate negro will be executed.
The articles referred to are not before us,
hence we arc necessitated to relv on mem
ory for what they contained. Some parts
of those communication, need not be an
swered in a civilized community, as they
carry with them answer sufficient, and
showed in what spirit they had been penn-
ed. We think, however, that the thrust
made at us may be taken a9 true
by some good people, if it be
passed unnoticed, and the impression
might go out that we were trying to pro
tect a murderer and encourage prostitution
v among the negroes. The hero champion
of Buzzard Roost charged that the woman
Jack claimed was not his wife.
Now to the facts: The State’s witness,
Brad Winn, swore she was Jack s wife
8he was put upon the stand and swore
Jack was her husband; that lie had mar
ried her: whereupon the court ruled her
no%i competent witness, under the law
that a wife cannot testify for or against her
husband. Jack, in his statement, said lie
had gotten a divorce from his slave-time
woman, because she* voluntarily took her
children, which were not his, and left him,
and that he had married his last wife
with a license. All this went to the
jury. The circumstances of the killing are
these: Jack had bought a gun some days
before the killing took place. He got it, ne
stated, to protect himself from the threat*
of the deceased. It was in evi
dence by the State that Jack
carried this cun backwards and forwards
- before the kming,openly and above-board,
thereby showing he told the truth. On the
night of the killing Jack learned of an ar
rangement between his wife and the de
ceased. He thereupon took his gnn, went
down the road neai where Dave Bowman
would meet his wife, heard bis wife call to
Dave, heard Dave reply that he would wait
there for her. and just before she got to
him Jack shot Dave with his shot-gun.
Not only was this the statement of the
prisoner, but the State's witness. Brad
Winn, swore that lie heard Jack’s wife call
to Dave and heard Dave's reply, as set out
above. There is no doubt but that Jack
prevented an adultery with his wife by the
killing. The Supreme Court decided that
a killing to prevent an adultery with a
man’s wife was justifiable homicide on the
part of the husband. While we feel like
the jury acted under conviction in taking
the State’s theory and not the defendant’s,
•‘III we thought ft a hard verdict under the
facts.
For this reason and others we applied
to the Governor for clemency, not for a
pardon but for a commutation of the
death sentence to life imprisonment. No
motive but that of a feeling of justice to
the doomed man moved us to make an
effort. Many of the best citizens of Hous
ton sigmd the ]*tition. It was the cause
of humanity that prompted them to sign

presentation of his case tj the jury. We,
the writers, feel that his death to-day was
an outrage, when we consider Ids good
character as proven by the State's most
reliable witness, and the influence that

his happiness. Any person with a spark
of humanity in his soul would be moved
for the unfortunate negro could he know

Atheks, July 15.—The address of Hon.
N. K. Harris, of Macon, before the alumni,
was delivered yesterday morning at the
chapel. Ilia subject was “8uccess and
Failure” and was treated in an interesting
and elegant style. Alluding to success
through many difficulties, he said: "But
time woukf fail me to mention all the
names that illustrate this truth. Suffer
me an instance nearer home. Oa the
batiks of the Ocmulgee river, in the quiet
little city from which I come, was born in
February, 1842, one destined to take rank'
in the forefront of America’s greatest ge
niuses. The youth of the boy gave little
indications of the power that slept in his
soul. Educated a lawyer, admitted to the
bar, he practiced his profession for a few
years, w hen the dread scourge of his f.ttu-
ily, consumption, seized on his frame and
forced him to abandon his chosen work.
While seekiug to regain his lost health and
pressed by want ot means to support him
self and family, he resolved to turn his at*
tent ion tolitcrature. Boor as lie was. ob
scure, almost friendless, with a fatal
disease already threatening his life, he yet
bad the courage and the will to essay
the difficult task of conquering a name
among (that most exclusive of all the
literart) the poets of the world. He boatted
no proud lineage to aid hint, no cross or
decoration glittered on his breast; no pat
ent of nobility accredited him to the
world. He could claim no traveled erudi
tion, no polished university training; he
waa only a Southern boy—a Georgian at
that and yet in that poor boy’s xml was
the tire of as grand a genius as ever lighted
the torch ou the altar of Fame's eternal
temple.
The story of his life is stranger than a
romance of ancient days. He succeeded,
too. He conquered poverty, he conquered
obscurity, he conquered disease, he con-
quered adverse destiny and by his own
true, will and genius lilted himself into the
company of the world's princes of thought,
ami made a name and a fame for himself
that cannot die. Critics and literary men
have already accorded him a position
among the first in American literature and
no thoughtful or candid student can rise
from thp perusal of his works without the
criticism that his name is destined to live
as long as poetry and music keep their
places in the human heart.
For only six short years his labor lasted,
yet into that time was crowded a struggle
such as was never paralleled in the history
of human endurance. He went out from
our midst almost unnoticed, yet the light
nings were scarce swift enough to bear
back the record of his triumphs. His bod
ily ills were forgotten when men saw hint
throwing into the syHabitd sweetness of
our mother tongue the music which his
grand soul caught from the diapason of
unseen harps, strung by the inhabitants of
those bright spheres, perhaps, where music
is the common language of the people.
Lack of bread for his children was the
fear that haunted his wasted heart. Gods!
how he struggled, And the grim con
sciousness crept upon him day by day
that he nursed in his frame a disease that
was wearing his life out. As he felt his
blood distill drop by drop, as he felt his
strength grow less and less day byunv, as
he felt uis footsteps near the* grave
with dread, relentless certainty, as he

iiet meadows and smiling hillsides, of
■y youth and bounding health, of music
<1 laughter, as though he spread his
thin, white hands above his people's head,
and longed for immortality.' Out of bis
sufferings came his success. His country
men, reading his verse, shill find their
own hopes pictured there. For them each
year his thoughts shall be renewed in the
blessings of the corn; they shall hear his
voice again in the murmur of themoun-l
tain streams; they shall feel his spirit near
in the whispers of the winds, see his face
right about their degradation, and we feel reflected in the pearl-tinted skies and catch
that it will be a long time before they will his great heart-throbs in the mighty waves

The Conaresslonnl Nomination.
There will be a meeting of the executive
committee of the sixth Congressional dis
trict at the court house in Macon on July
30 at 10 o’clock a. m., for the purpose of
reorganization and to select a time and
place for holding a convention to nominate
a Congressman for this district. The new
counties added to the district by the last
legislature are earnestly requested to be
represented at this meeting.

Habeas Corpus Case.
A habeas corpus case comes up before
Judge Holt of the County Court this morn
ing. The bone of contention is a child of
a woman now dead. Since her death a
sister, Anna Bishop, has taken care of the
orphan; but another sister, Elizabeth
Jones, does not seem to think Anna a fit
person to take caretof it. About a month
or so ago a writ of habeas corpus was sued
out by Elizabeth, and it was heard by
Judge McManus, the “nlinarv. He *L
lowed the child to remain in the custody
of Anna inasmuch as Elizabeth had a
family of several children herself. Now.
Elizabeth will make another effort to se
cure the child.
Death of Miss Stewart.
The funeral of Miss Lizzie Stewart,
daughter of Mr. Jeff Stewart, took place
yesterday. Miss Stewart il:ed on Sunday
night of gastric fever, at her father’s resi
dence, near Clinton. The remains were
interred at the old Giawton place, the
family burial-ground.
