ment to the Constitution of Geor
gia to be voted on at the General
Election to be held on Tuesday,
June 3, 1941, amending Article
7, Section /, Paragraph 1, of the
Constitution of Georgia, so as to
authorize Evans County by vote of
its fiscal authority to issue, in ad
dition to all other bonds, Funding
tßonds sufficient in amount to pay
off and retire the designated war
rant and script indebtedness of
said County; to provide that in the
event such warrant indebtedness is
paid »off and retired that said
County shall thereafter operate on
a strictly cash basis and be pro
hibited from issuing warrants or
orders payable in the future; to
provide that the bills and claims
of and against said County and its
Treasury shall be paid by check
and how such checks shall be ex
ecuted; to legalize tax levies and
to authorize the levy and collec
tion of a tax in the current year
for use, all or in part, for the
operation of said County for the
ensuing year; to provide how said
( bonds shall be authorized, validat
ed and issued; to require the fis
cal authority of said County to
make provision for paying off and
retiring said bonds; to provide that
the proceeds of said bonds shall
be used exclusively for paying off !

WHEREAS, The General As- ;
sembly at its session in 1941 pro- I
posed an act amending the Con
stitution of this State and it was
approved March 27, 1941, as set
forth, to-wit:

BONDS FOR EVANS COUNTY

To propose to the qualified vot
ers of Georgia an amendment to
Article 7, Section 7, Paragraph 1,
of the Constitution of Georgia, so
as to authorize Evans County by
vote of its fiscal authority to issue,
in addition to all other bonds,
Funding Bonds sufficient in
amount to pay off and retire the
designated warrant and script in
debtedness of said County; to pro
vide that in the event such war
rant indebtedness is paid off and
retired that said County 4 shall
thereafter operate on a strictly
cash basis and bo prohibited from
issuing warrants or orders payable
in the future; to provide that the
bills and claims of and against
said County and its Treasury shall
be paid by check and how such
checks shall he executed; to legal
ize tax levies and to authorize the
levy and collection of a tax in the
current year for use, all or in
part, for the operation of said
County for the ensuing year; to
provide how said bonds shall be
authorized, validated and issued;
to require the fiscal authority of
said County to make provision for
paying off and retiring said bonds;
to provide that the proceeds of
said bonds shall he used exclusive
ly for paying off and retiring a des
ignated warrant indebtedness; to
provide for the submission of this
amendment for ratification or re
jection by the people, and for oth
er purposes:
BE IT ENACTED by the Gen
eral Assembly of the State of
Georgia, and it is hereby enacted
by authority of same:
Section 1.
That Article 7, Section 7, Par
rgraph 1, of the Constitution of
Georgia, which has heretofore been
amended, shall be further amend
ed by adding thereto a paragraph
in >tho following words lan
guage, to-wit:
Provided, however, that in addi
tion to the bonded indebtedness
now or hereafter authorized by
this Constitution, and without re
striction as to the limitation of
taxable values of property for
bond purposes, Evans County is
hereby authorized and empowered
to issue bonds sufficient in amount
to refund, pay off, and retire all
unpaid, outstanding and existing
warrant and script indebtedness
of said County, including interest
due or payable thereon, as the
same appears of record in the of
fice of the Commissioners of Roads !
and Revenues of said County on
the date as determined by the gov- j
erning authority of said County,
which date shall be not earlier than
10 days and not more than 60 days
next after the date of the proc
lamation of the Governor declar
ing this amendment ratified; said

In the event the privilege grant
ed herein ia exercised by said
County after said date as so de
termined by said governing au
thority, said County and the gov
erning authority thereof are pro
hibited from issuing warrants and
deferred payment orders on the
Treasury of said County, and said
County shall thereafter be operat
ed on a cash basis, so that all bills
and claims chargeable to or against
said County or payable by the
Treasury of said County shall be
paid monthly or otherwise as may
be determined by the governing
authority of said County, by checks
drawn on the depository or depos
itories holding the funds of said
county, and in no other way;
no speh checks to be is
sued and delivered unless funds
are on deposit sufficient to imme
diately pay same and all other
then outstanding checks, all such
checks to be signed by the Chief
Executive Officer of said govern
ing authority, and countersigned
by the Clerk Board County Com
missioners of said County, with
the right in said governing author
ity to borrow money to supply cas
ual deficiencies in revenue as
heretofore authorized by this Con
stitution. All tax levies for lawful
County purposes heretofore made
and made in the year 1941 and in
each year thereafter by the gov
erning authority charged with the
duty of managing said County’s
affairs shall be legal, with the ex
press power and authority in said
governing authority to levy and
'collect taxes for lawful County
purposes for the then current year
for use all or in part in the oper
ation of said County for the next
ensuing year. No violation of any
provision of this amendment as to
the conduct of the fiiscal affairs
of said County after the date de
termined by the governing author
ity for the issuance of Funding
Bonds shall in any wise affect or
impair the validity of said Funding
Bonds.
Said Funding Bonds shall have
such terms and provisions as to
maturity, rate of interest, and oth
erwise as may be fixed by the gov
erning authority of said County,
provided, however, that said bonds
must all mature within thirty
years from date of issuance. Pro
vision shall be made by the gov
erning authority by resolution for
the assessment and collection of
an annual tax sufficient in amount
to pay the principal and interest
of said Funding Bonds as they
respectfully become due, and the
proceeds of said bonds shall be
used exclusively for the purpose
of paying and retiring the war
rant indebtedness and interest
thereon of said County, as may
be determined by the date set by
the governing authority of t said
County. Said Funding Bonds shall
be issued under the authority here
of when so authorized by a ma
jority vote and resolution of the
governing authority of Evans
County, but without the necessity
of an election as in the case of
original obligation bonds of said
County, and shall then be validat
ed in the manner and under the
procedure as is provided by law for
the validation of original obliga
tion bonds.
Section 2.
Be it further enacted by the
authority aforesaid, that when
said amendment shall be agreed to
by two-thirds vote of the members
of each House, with the “ayes"
and “nays" thereon, the Governor
is hereby directed to have this pro
posal published in one or more
newspapers in each Congressional
District in this State for the two
months previous to the time for
holding the next general election
at which proposed amendments to
the Constitution of this State may
be voted on, and shall at said elec
tion be submitted to the people for
ratification or rejection. All per
sons yoting at said election in fa
vor of adopting the said proposed
amendment to the Constitution
shall have written or printed on
their ballots the words, “For rati
fication of amendment to Article
7, Section 7, Paragraph 1, of the
Constitution, so as to authorize
Evans County to issue Funding
Bonds, and thereafter to operate
on a cash basis, and for other pur
poses,” and all persons opposed to
the adoption of said amendment
shall have written or printed on
their ballots the words, “Against
ratification of amendment to Arti
cle 7, Section 7, Paragraph 1, of
the Constitution, so as to authorize
Evans County to issue Funding
Bonds, and thereafter to operate
on a cash basis and for other pur
poses." And if a majority of the
electors qualified to vote for mem
bers of the General Assembly, vot
ing thereon shall vote for ratifica
tion thereof as provided by law,
when the result shall be considered
as now required by law in elec
tions for members of the General
Assembly, then said amendment

become a part of Article 7,
Section 7, Paragraph 1, of the
Constitution of the State of Geor
gia, and the Governor shall make
proclamation therefor as provided
by law. 4
Section 8.
1 Be it further enacted that all
laws, or parte of laws, in conflict
herewith be, and the earne are,
hereby repealed.
