4A Midweek Edition-January 10-11, 2024 The Times, Gainesville, Georgia I gainesvilletimes.com LOCAL FROM 1A Hutchinson Shamus Matthew Hutchin son, 36, pleaded guilty to first- degree vehicular homicide Dec. 21 among other charges. Supe rior Court Judge Bonnie Oliver sentenced him to 18 years with the first four years in custody. However, the judge allowed Hutchinson to serve 36 months of his custodial sentence in the work camp overseen by the Hall County Correctional Institute warden. Defense attorney Jacqueline Piland, who worked the case with attorney Kim Stephens, said Hutchinson will be housed in the Hall County Jail. Unlike work release where an inmate is allowed to continue working an outside job while incarcerated, the work camp often involves public work jobs like roadwork. If Hutchinson completes it, his four-year cus todial time will be suspended, and the remainder of the sen tence is on probation. “It's still a custodial sen tence,'’ Stephens said. “It's not something that he can go home at night or go out and work a regular job.” The case concerned the Jan. 14, 2022, crash on Hog Moun tain Road that killed Mitchell Blae Anderson, 31, of Athens. According to Georgia State Patrol, Hutchinson was driving the wrong way around 8:44 a.m. in the northbound lane of Hog Mountain Road. Hutchinson was going 61 mph in a 45-mph zone, accord ing to the indictment. Hutchinson struck Ander son's car head-on near Wade Orr Road, according to the report. After impact, Hutchinson's car ran off the road, while Anderson's car rotated and hit a third car. Anderson died Jan. 27, 2022. According to his obituary, Anderson served in the U.S. Navy in the submarine force, earning multiple medals and accolades. “He sounded like he was loved by his family,” Piland said of Anderson. “He was a very good person, and it's just a tragedy all around for both the victim and for my client.” Hutchinson was indicted on three counts of first-degree vehicular homicide, two counts of driving under the influence of drugslless safe), reckless driving, driving on the wrong side of the road, speeding and possession of heroin. The her oin possession charge was on a different date than the wreck, according to the indictment. Though the legal limit in Georgia for blood alcohol con centration is 0.08, law enforce ment can still charge “DUI(less safe)” if the person is under the influence of drugs or alcohol “to the extent that it is less safe for the person to drive,” accord ing to Georgia law. While the case only involved one death, the three vehicular homicide counts were predi cated on the driving under the influence counts and the reck less driving charge. The drugs that the prosecu tion alleged were in Hutchin son's system were: trazodone, an antidepressant/sedative; mitragynine, commonly known as kratom; and quetiapine, an antipsychotic medication. The prosecution dismissed two of the vehicular homicide counts and the two driving under the influence charges, stating they felt there was prob able cause for the warrant but not enough evidence to prove beyond a reasonable doubt. Piland said there were no illicit substances found in his system, and the medication was at such a low amount that “there was no way you could show that he was under any influence.” Piland said Hutchinson was “very remorseful.” “He wanted to go ahead and take responsibility for that so he could start paying his debt back,” Piland said. Oliver ordered Hutchinson to serve 400 hours of commu nity service “in a rehab mentor ship capacity” and complete all aftercare at Project Adam, an addiction treatment service. Hutchinson's license was sus pended, and the judge ordered Hutchinson to not even be in the front seat of a vehicle for the first 24 months on probation. Hutchinson was also ordered to pay $3,662.50 in fines and surcharges.
