SUIT FOR HALF A MILLION.
HEIRS SEEK TO RECOVER PROPER
TY THAT WAS SOLD.
Claim I* Founded nil a Morrlasre
Controet—Trouble < nuseil by the
Old Utv V'nder Which a Wife’*
Property Went to Her Ibnhand.
The Heim Vow Claim the Property
Wan Illesrn lly Sold by the Trustee.
Atlanta. Aug. 7.—Property worth over
half a million dollars is involved in suits
filed to-day by Attorney Ulysses Lewis,
for John Trammell and his sister, Mrs.
Hattie Turner, of Atlanta and Mrs. Mat
tie Neill of Augusta.
The bulk of the property Is in Atlanta,
but some of It is In other part? of the
state. The Fulton county property is lo
cated on Forsyth, Marrietta and Court
iand streets and near the McDonough
road. Other parcels are In different coun
ties in this state.
Three suits were filed in the Superior
Court to-day against the owners of the
Forsyth street property. The contentions j
In the TrammeJl case are somewhat simi- j
lar to those in the celebrated Hayden
case.
As In the Hayden case the claim is
founded on a marriage contract. The i
plaintiffs are the only children of Mrs.
Lucinda A. Trammell, and John G. Tram- :
me]!, Mrs. Trammell was a daughter of
Daniel Walker. Her firs* husband was
Joseph Prince. She was a young widow |
at the time of her marriage to Mr. Tram- !
moll in 1846. Under the law at the time j
of the second marriage all of the woman's ;
property went to her husband. In order j
to preserve a separate estate it is said.
Mrs. Trammell’s brother Dickerson H.
Walker was made trustee of her property
during her life, wiih the provision that j
at her death ft should go to her children
or their heirs *
The children of Mrs. Trammell claim
that real estate belonging to her was il
legally sold, and they have instituted
proceedings to recover it from the pres- j
em owners. Their contention Is that Mrs.
Trammell, or her trustee, could sell only
bar life interest in the property and that
Mrs. Trammell having died Jan. 8, 1898
her children now come in as remainder
men. .

Important Decision Favorable to
Street Hallway*.
Atlanta, Aug. 7-The Supreme Court to
day sustained the decision of Judge J. H.
Lumpkin in the injunction suits of the
Southern Railway against the Atlanta
Rapid Transit Company, and the Atlanta
Railway and Power Company, holding that
a street railroad could cross a steam road
on a public' highway without instituting
condemnation proceedings or paying dam
ages. The crossings involved were the
one of the Rapid Transit Company on De
catur street and the one of the Railway
and Power Company on Henderson’s
Crossing The street railways had ob
tained permission from the city and county
authorities to cross the Southern’s tracks,
but the latter company claimed It would
be seriously damaged, and appealed to the
courts for protection.

fore that case was decided, the suit

instituted. It was argued a few weeks

the argument the decision in favor of the
street railway companies was rendered.
