Judge Falligant granted an order in the Superior Court yesterday, restrain ing and enjoining the Foatal Tel-graph Cable Company and Charles F. frend*r gaet. from pro<'eeding further with Its action to condemn the right of way of the Kavannah. Florida and Western Rill way In Dougherty. Mitchell. Thomas. Brooks and Lowndes, counties, and requir ing them to show cause October 6. why a permanent injunction should not be grant ed. The order Is the result of an attempt on the part of the Postal Telegraph-Ca ble company to condemn the right of wav for a telegraph line along the tra ks of th© railway company from Valdosta, to Thomasvllle, and from Thomasvllle to Albany, a distance of about 1&! wale*. It seems from the papers filed in the case that the effort upon the part of the tele graph company to peacefully secure the right to use the right of way of the rall w iy company was rebuffed by the latter, and that it was necessary for the former to resort to condemnation proceedings, which It seems the railway company Is also preparing to resist to Ihe full extent of Its ability. Having failed to obtain the desired priv ilege from the Savannah, Florida ami Weatern Railway, the Postal THegroph- Cable Company give notice as required by iaw. citing the fact* n*l circumstance# of the case, and the statute* of the Kni fed Suite* mij*l of Georgia, provided for such •#!** **. The Savannah, Florida and Weatern, It would ii*p-.-r from It* | tit lon. does not choose to follow this method, hut pr**fr rather to tight the matter in the courts An Injunction is sought n n numb, r of grounds, among which It is asserted that the statute* namd In the notice from the felt-graph company aro un-onst it tit tonal, ami that the tebgraph company ha* no right to Institute or maintain condemna tion proceedings begun under and by the notice given. It I* claimed that no valid ap|*el is provided by law under the sta*- ttic* of Georgia, ami parti ularly the stat ute* referr***! to In the notice by whl h the railway company can appeal from the • le. latnn of th* arbitrators, and that this failure make© the statutes Illegal and void. It I* al*o claimed that under the constitution of the state such proceeding* can only be had In the county in which the land I* ©Hunted, and that the condem nation proceedings Itia'liutcd In Chatham county are void. It is asserted that the land sought to he condemned Is not n* s c*©nry for the ue of the telegraph < omiuny In con structlng Its t- legraph line referred to and that under the laws of the state It has no right to acquire the same except by amicable purchase from the petition er It Is aho c aimed that the erection of the tebgraph pole* alQng the right of way of the railway would further en hance the risk and danger of operating Its trains, such poles bt ing liable to be blown down across the track or burned down nt Ihe has**, thereby resulting In wrecks and damage to the petit loner. It is also urge*! that should the railway company appoint an arbitrator, as requir ed by the notice set forth that the arbi trators could not consider the various ob jections mentioned, nor the vaddlty of the statutes under which proceedings have been Instituted, nor whether the land and privileges desired are necessary for the us** of the telegraph company In construct ing its line, nor could they pass upon various other Issues involved and that they would be able to <bt-rmlne nothing whatsoever except the amount of damage which would I>e sustained by the peti tioner and Htfwessfd as damage* against Ihe telegraph iVwnpany.
