ed drinking and gone, he came to the
west end of the bar which was nearest to

Fleming got up and went to the end of
the bar. Home words were passed, but
the witness said be did not know what
they were. He next saw Davis leaning
over the counter, evidently supported be
low by something higher than the floor.
He had . knife In his hand. The witness
picked up a knife that is used In the bar
and said that he thought that that was
the on*. Davi.*. was In the act of lean
ing over the counter with the knife when
the next thing that Harley realised Flem
ing hada pteto! In his hand and fired twice
while Davis was leaning over the coun
ter. and once ngutn ns !• turned away.
While the men were In the position de-
•ertbod Just before the shooting took place,
the witness sakl that Davis had applied

him He did not see Fleming draw the

was when It was In the air. Wiinesn
further sold that the shots were fired in
rapid succession. amt that he thought
that the last shot had riot struck Davis.

Fleming stood at the counter with his
hands resting on it. When Davis threat
ened him he neither advanced nor retreat
ed. Davis had the knife raised when the
first shot was tired. The witness said
that he thought that Davis had had no

After h had fallen In the door a negro
port. i. Charles Ana:ln. went to him and
getting on his knees raised up the dead
men and with the assistance of another
took him to tlx room in the rear of the
bar.
As to the relationship of the men. pre
vious to the shooting the witness said that
there had been some difficulty the night
before. The quarrel w-as on account of
the hours that each was kept on duty.
On the night In question Davis,
when he had quit work, put on
hi* coat uni hat and walked
out from behind the bar. There
with a friend he hud catted for drinks nisi
afterward, lie said to Fleming, who hud
waited on him "You showed the white
feather last night In sending for Mr.
Powers to deckle ulout these hours. You

According to the witnesa Davis attempt
o*t to get over the counter a* though he
was looking for a fight, but was prevented
by Mr Glnna. a traveling man Austin,
the colored porter, came In the bar at that
time and told Davis that Mr. Watson and

and with the aid of Mr. Glnna, Austin
pushed him out of the door.
- To quaatlona by Coroner Goatte and the
Jurymen, the witness soli that Davis had
on no coat at the time of the ehooting,
and that he had not. as far as he knew
any weapon except the knife. He thought
that Davl* was Intoxicated, as he a* ted
that way. and he himself had seen him
take one drink
The witness continue*) his story of the
previous quarrel by saying Ihai when he
had seen Davis In the morning he had
told him that Fleming had called him a
vile name the night before, und he In
tended to make him retract it dtlll later

about having a settlement of the matter
The last remark of this sort, and the one
that led the witness to think that there
might be trouble, was when Davis had
aaid to him, “Harley, when Fleming oome

who Is a young German, alleges that on

of a sausage machine. The machine Is
alleged to have been defective and out of
order. In consequence of these defects It
Is alleged that Jerkshatt’* right hand was
caught in Iho machine and Injured so that
the amputation of all the lingers except
the Utile finger was required. The suit

the Superior Court yesterday, restrain
ing and enjoining the Foatal Tel-graph
Cable Company and Charles F. frend*r

action to condemn the right of way of
the Kavannah. Florida and Western Rill
way In Dougherty. Mitchell. Thomas.
Brooks and Lowndes, counties, and requir
ing them to show cause October 6. why a
permanent injunction should not be grant
ed.
The order Is the result of an attempt
on the part of the Postal Telegraph-Ca
ble company to condemn the right of wav
for a telegraph line along the tra ks of
th© railway company from Valdosta, to
Thomasvllle, and from Thomasvllle to
Albany, a distance of about 1&! wale*. It
seems from the papers filed in the case
that the effort upon the part of the tele
graph company to peacefully secure the
right to use the right of way of the rall
w iy company was rebuffed by the latter,
and that it was necessary for the former
to resort to condemnation proceedings,
which It seems the railway company Is
also preparing to resist to Ihe full extent
of Its ability.
Having failed to obtain the desired priv
ilege from the Savannah, Florida ami
Weatern Railway, the Postal THegroph-
Cable Company give notice as required
by iaw. citing the fact* n*l circumstance#
of the case, and the statute* of the Kni
fed Suite* mij*l of Georgia, provided for
such •#!** **. Including that provided for
tne condemnation of a railway company's
tight of wny by a tel*grap: company, it
ilso named Mr. Charles F. Prendergast

privileges desired are necessary for the
us** of the telegraph company In construct
ing its line, nor could they pass upon
various other Issues involved and that
they would be able to <bt-rmlne nothing
whatsoever except the amount of damage
which would I>e sustained by the peti

Ihe telegraph iVwnpany. For these and

affair, lie thought hi# child had been

him. The father, with the child In his
arms, ran after him. and he held up for
a few moments. The two men had some
word*, and the father w.is angry and ex

the request of the boys' counsel, who
slated lhat he expected *o represent them

A peculiar feature of the case is that
yesterday morning the pistol that Ini
lieen taken from Hetslnger A Co.'* store,
was found In the cellar of the store wheic
It had been thrown through Ihe grating,
either the night before or early yesterday
morning. The pistol was "broken'' so
that It would not lie fired by contact with
the floor of the cellar.
Another fact that came to light yester
day ami has considerable hearing on the
case, as showing that th* boy hud an un
usual amount of money. Is that he pur

ted. In addition to the other articles al
ready mentioned, a bicycle for which he
paid 17. Kgense Is still out on bond, but
