Atlanta. Sept 25—Mrs. Annie L. Cole
man and R S. Hyer appeared In the
Superior Court thU morning, os plaintiffs
In a ault to obtain an Interest In a dam
age suit, pending In itte City Court. They
want a pari of a Judgment which has
not yet lieen rendered, and which may
never be.
Thr defendants are, Mrs. Fannie Hyer
and thr Western and Atlantic Railroad
Mrs. Hyer Is stepmother to the plaintiffs.
Thr stepmother Is suing the Western and
Atlantic Railroad for 225.and thr plain
tiffs seek to enjo'n the Western and At
lantic. from paying to her more than one
third of the verdlcf tf It Is rendered In
her favor.
Several months ago. William 1., Hyer
was killed in n head-end collision on the
Western anil Atlantic Road. He had been
married twice. By hla first wife hr had
two children and by his last wife non.
After his death, thr widow' Instituted suit
ngatr.st Ihr Western and Atlantic Hoad
for 225.000 damages. The children of his
first wife now want an Interest In her

Kleckley narrowly escaped with her life
in a serious runaway accident this after
noon A horse attached to a carriage ran

collided with another team, overturning

among struggling horses and dismantled
vehicles. Hhe was rescued by spectators

young lady of 17, died this morning, as
the result of a peculiar accident, Quite
