Petition For Charter STATE OF GEORGIA. COUNTY OF DADE. TO THE SUPERIOR COURT OF SAID COUNTY: The petition of A. L. Dyer, Mrs. A. L. Dyer and Mary Elene Dyer, all of Trenton, Georgia, shows: —1— The petitioners desire to in¬ corporate for a period of thirty- five (35) years with the right of renewal as provided by law un¬ der the style and name of “DYER LUMBER COMPANY, INC.” —( 2 )— The principal office and place of busness of said corporation shall be in Trenton, Dade Coun¬ ty, Georgia, with the privilege of establishing branch offices, when authorized by a majority vote of the Capital Stock of said corporation outstanding at the time entitled to vote. — 3 — Said corporation proposes to operate a lumber mill to cut, distribute, sell (both wholesale and retail) lumber and to do any business incidental thereto. The Capital Stock of said cor¬ poration shall be $50,000.00, di¬ vided into five hundred (500) shares of capital stock of the par value of one hundred ($100.00) per share, with the right and authority to increase Capital Stock from time to time upon a majority vote of the Capital Stock of said corporation out¬ standing at the time entitled to vote. The Capital Stock with which the corporation shall be¬ gin business shall be $18,000.00. Said corporation shall, by a majority vote of its outstanding capital stock have authority to make all necessary by-laws and regulations and to do all things that may be necessary for the successful management and car¬ rying on of said business as out¬ lined above, including the right to accept in payment of stock subscriptions, money or proper¬ ty, or other things of value ta¬ ken at a fair valuation. WHEREFORE, petitioners pray that this petition be filed, and that an order be passed grant¬ ing said charter for a period of thirty-five (35) years, with the right of renewal as provided by law. S. Highway No. 11. Said tract includes a 15 acre tract con¬ veyed by James A. Case to Leroy Case by deed dated June 1, 1892, recorded in deed book “L” page 126; a tract of IVt acres, more or less, which is described in deeds from Robert Carter, Sheriff, to Leroy Case, both dated April 2, 1895, recorded in deed book “L” page 691 and page 693 respectively; a 1/2 acre tract conveyed by Doswell H. Rogers to Leroy Case by deed dated April 21, 1919, not yet recorded, and a tract of V 2 acre, more or less conveyed by John A. Wilkin¬ son to Leroy Case by deed dated December 7. 1893, which is recorded in deed book “L’ page 388, in office of Clerk Superior Court, Dade County, Georgia. SECOND TRACT: Part of Lot No. 36 in the 11th Dis¬ trict and 4th Section of Dade County, Georgia, commenc¬ ing at the Northwest corner of said lot; thence East with fence to center of branch known as Brown Spring Branch; thence a Southwest direction with center and meanderings of said branch ot the the District Line; be¬ ing also the line between Lots Nos. 8 and 36; thence North with District line to beginning point, containing 26 acres, more or less. Beng the same property described in deed from Mrs. Martha J, Wheeler to Leroy Case, dat¬ ed September 9, 1912, re¬ corded in office of Clerk of Superior Court, Dade Coun¬ ty, Georgia, in Deed Book “R" pages 54-5. THIRD TRACT: Part of Lot No. One (1) in the 11th district and 4th section of Dade County, Georgia, com¬ mencing at Railroad right- of-way line, the Northeast corner of this tract on south line of formerly Austin, now Stevenson property; thence South to dividing iine be¬ tween this tract and the lands formerly known as the Houston Wheeler land; thence Westwardly on con¬ ditional lne between this property and said Wheeler property to the District line, thence Northward to South line of said land formerly known a 3 Austin, now Ste¬ venson property; thence East with said Stevenson line to the beginning, con¬ taining 35 acres, more or less. Being the same prop¬ erty conveyed by John E. Price to Leroy Case by deed dated April 28, 1908, record¬ ed in office of Clerk of the Superior Court of Dade County, Georgia in Deed Book “Q” pages 280-281. FOURTH TRACT: Part of Land Lot No. 157 in the 19th district and 4th section of Dade County, Georgia, be¬ ginning at a water gap on the line between this prop¬ erty and the property known as the Shook Pace property in the center of Town Creek as the same ran July 1, 1918; thence following said line southwardly to the edge of the public road; thence Westwardly with north side of the road to fence corner where public road branches to White Oak Gap; thence Northwardly with fence to a point in a water gap in center of Town Creek; thence Eastwardly with cen¬ ter of said creek as it ran July 1, 1918, to beginning point, containing four (4) acres, more or less. Being the same property conveyed by John L. Case to Leroy Case by deed dated July 1, 1918, which deed has not yet been placed of record.
