X EDITORIAL ^ ATTORNEY GENERAL COOK HOLDS THOMPSON ENTITLED TO GOVERNORSHIP On next Tuesday, January 13, the General Assembly of Geor¬ gia convenes in Atlanta, and will proceed to open and publish the returns of the last general election, held on Nov. 5, 1946 Alter having received a majority of the unit votes for Gov¬ ernor at the Democratic Primary, held in July, 1946, Eugene Talmadgc, now deceased, was duly declared the Democratic nom¬ inee- There being only one man nominated, the late nominee was duly elected Governor of Georgia without opposition. At the Primary and General state election, M. E. Thompson was duly elected Lieutenant Governor of Georgia, also without opposition As there was no opposition to the late Governor-Elect Talmadge in the General election, a few private citizens received a very few' complimentary written in votes, among them being Herman Talmadge, son of the late Governor-Elect Talmadge, who certainly was not a candidate against his Father. Yet this same son of the late Governor-Elect, casts aside all loyalty and respect he should hold for his deceased father, to gratify an abnormal,' egotistic ambition, and presumes to ask an intelligent Legislature, on a flimsy technicality, to declare him duly elected governor of the great State of Georgia- In an official opinion given at the request of Governor Arnall, Attorney-General Eugene Cook rules that the Legislators have only one duty to perform in the premises. -, lt shall be ttie duty of the President of the Senate arid Speaker of the House of Representatives to open and publish the returns in the presence and under the direction of the Gen¬ eral Assembly; and the person having the majority of the whole number of voles shall be declared duly elected Governor of this state.” Attorney-General Cook further rules: ‘ Since it is a matter of common and public knowledge that tihe late Honorable Eugene Talmadgp was the only candidate of the official ballot at said election for the office of governor, and received (hat constitutional majority of votes cast, the duties of the Legislature are exhausted when they shall so publish and declare.” Under the provision of the new Constitution of Georgia the office of Lieutenant Governor was created. The main reason for the creation of this office was to provide a competent offi¬ cial to succeed to the office of governor in case of resignation or death of the State’s Chief Executive; and it is inconceivable that a rational man, however great his ambition, should ask our law-makers to nullify the Constitution to satisfy that personal ambition. Herman Talmadge is reputed to be an intelligent, even brilliant, young man, but this disrespect for his late lamented father as manifested in his effort to become governor, makes us wonder if he is not an ingrate or a tool in the hands of cheap politicians. When the General Assembly of Georgia assembles on next Tuesday morning, we believe they will do their full duty as true representatives of the people, and will declane M. E. Thompson duly elected Lieutenant Governor, after which he will, upon resignation of Governor Arnall, become Chief Executive, to which he was indirectly elected.
