Finishing and Dressing Said work shall begin within ten (10) days after formal cution of contract and shall be completed within 180 working days When contract has been executed, written notice shall be given the Contractor, at which time, and not before, work may started. Contract executed pursuant to this Notice is binding on the State Highway Department, as such. Said contract will not create liability, expressed or implied, against the undersigned Director ol the State Highway Department, as an individual nor against anj employee of the State Highway Department, in his or her individ¬ ual capacity. The minimum wage to be paid under this contract shall be the amounts set out in the Labor Provisions included in the Pro¬ posal. The attention of bidders is directed to the Special Pro visions covering employment of labor, methods of construction subletting or assigning the contract and to the use of domestic materials. Plans and specifications are on file at the office of the un¬ dersigned at Atlanta, and at Gainsville, Georgia and at the office of the Board of County Commissioners of Dade County at Tren¬ ton, Georgia, where they may be inspected free of charge. Copies of the plans may be obtained upon payment in advance of the sum of $13.80. Copies of the General Specifications may be ob¬ tained upon payment in advance of the sum of $3.00 which sum:- will not be refunded. Proposals must be submitted on regular forma, which will be supplied by the undersigned, and may be obtained by a payment, in advance of $5.00 for each proposal issued. When the proposal is submitted, it must be accompanied by a certified check, cash¬ ier’s check, negotiable United States Bonds, or other acceptable security in the amount of $9000.00, and must be plainly marked “Proposal for Road Construction,” County and Number, and show the time of opening as advertised. Check of the low bidder be cashed and all other checks will be returned as soon as the contract is awarded, unless it is deemed advisable by the State Highway Department to hold one or more checks. If an unusual condition arises, the State Highway Department reserves the right to cash all checks. Bidders Bond will not be accepted. Bonds will be required of the successful bidder as required by law. Contracts will not be awarded to contractors who have not been placed on the list of qualified Contractors prior to the of award. No proposal will be issued to any bidder later than 12 Noon Eastern Standard Time of the day prior to the date of opening bids. » All bids must show totals for each item and total amount of bid. Right is reserved in the undersigned to delay the award of the contract for a period not to exceed thirty (30) days from the date of opening bids, during which period bids shall remain open and not subject to withdrawal. Right' is also reserved in the undersigned to reject any and all bids and to waive all formalities. Upon compliance with the requirements of the Standard Specifications, Ninety (90) percent of the amount of work in any calendar month will be paid for by the 25th. day of succeeding month, provided that payrolls have been submitted required and the remainder within thirty (30) days after the Final Statement is approved by the Engineer. Pace) No fires reported last week, but there are places in this county that burnes every year that is not your rangers fault. There is someope in your com¬ munity that is doing that and someone knows who it is. If you won’t tell your ranger or the Grand Jury, talk to them Ask them to quit, tell them how they are dangering you and I. If they wont’ quit then quote the law to them, which is: — Section 9—Subsection (b) of Natural Resources Act:—lb) That the Director of Forestry with the approval of the Com¬ missioner is authorized to ap¬ point fire wardens to enforce the provisions of the fire laws of the State and the wardens so appointed and the fire fighting crews under their direction may enter upon any land for the purpose of preventing and sup¬ pressing fires and enforcing the provisions of the fire laws of the State. That any fire burn¬ ing uncontrolled on any forested, cut over, brushland or grass Lands is hereby declared to be a public nuisance by reason of its menace to life and property. Any person, firm or corporation responsible either for the start¬ ing or existence of such fire is hereby required to control or extinguish it immediately, and if such person, firm, or corpor¬ ation shaH refuse or neglect to do so, any organized fire supv pression force may suppress the •nuisance thus constituted, by controlling and extinguishing the fire and the cost thereof may be recovered from said re¬ sponsible person, firm or cor¬ poration. That the said Director, with the approval of the Com¬ missioner, is hereby empowered and authorized to fix definite periods of time not to exceed thirty days in any calendar year, during which woods or unculti¬ vated lands or marshlands may be burned over and to promul¬ gate same. CODE OF GEORGIA LAW 1933 SECTION 26—3601. Firing of woods prohibited; exceptions, notice ; punishment. 26-3601 (227-229 P. C. ) Firing woods prohibited: exceptions; notice; punishment. No person not a resident of the county where the firing is done, owning lands therein or domiciled there¬ on, outside of any incorporated town, shall set on fire any woods lands, or marshes, nor shall such person do so, except during the month of January and February. When such person shall desire to set fire within said time he shall notify all persons who oc- cupy lands adjoining him, by residence thereon, or cultivation, or inclosure of any portion of the tract or settlement, of the day and hour of the firing, at least one day prior thereto. Such notice need not be given if, on a sudden emergency, due caution should require firing to render one’s premises safe. Any per¬ son setting fire in violation of this section shall be guilty of a misdemeanor. (Act 1847, Cob. P—64 Acts 1878—9 P63, P. 144.) CODE OF GEORGIA LAW 1933 SECTION 26-3602. Penalty for letting woods catch fire, etc.—Persons who either, by themselves, or agents, permit fire to get into the woods, lands or marshes, through neglect, are within the meaning of the pre¬ ceding section. CODE OF GEORGIA LAW 1933 SECTION 26-7704. (748 P. C.) Setting fire to Woods.—Any person who shall willfully, carelessly, or negligent¬ ly set on fire, or cause to be set on fire, any woods, lands, or marshes, so as to cause loss or injury to another, shall be guilty of a misdemeanor. (Cobb, 824. Acts 1865-6, p. 233; 1898, p. 60). AN ACT PASSED BY THE STATE LEGISLATURE, 1943. To amend Chapter 26-36 of the Code, same being entitled, “Fir- ing the Woods," by adding a new section thereto to be known as Section 26-3603 providing that it shall be a felony for any person to maliciously and willfully fire woods; and for other purposes. BE IT ENACTED BY THE GEN¬ ERAL ASSEMBLY GF GEORGIA SECTION 1 That Chapter 26-36 of the Code same being entitled “Firing the Woods,'’ be amended by adding a new section thereto to be known as Section 26-3603 and to read as follows: “Any person who willfully and maliciously sets fire to woods, lands or marshes, shall be guilty of a felony and so punished.” SECTION 2 Upon conviction, such person shall be punishable by confine¬ ment in the penetentiary for not less than one (1) nor more than two (2) years.
