“MORE LITIGATION’ —
Last week a three-Judge Superior
Court at Atlanta rer. derad a decis
ion adverse to the contentions of
Talmndce’s attorneys in his “dicta
torship.” The court held by a 2 to
1 decision, it had the power to en
quire into the legality cf his ouster
of the State treasurer and his ap
pointment of a do ■facto officer to
that post. It also held it could dc
cide. when tho question is presented,
what are legal expenditures in thc-
absence of an appropriations bill.
The decision was rendered in a suit
by Atlanta banks asking whethei
they should recognize claims cn $2.-
500,093 in deposits made by suspend
ed Treasurer George B. Hamilton or
DeFnr* Treasurer J. B. Daniel. They
also asked the return of S7.500.00 in
depository security bends previous
ly posted with Hamilton which Ham
ilton had placed in the Federal Re
serve Bank vaults before his removal
by National Guardsmen. Talmadge
attacked the decision saying he knew
of no law by which a majority of
n three-judge court rules. He said
the decision would be appealed im
mediately to the Supreme Court and
there probably wouud be “mon
litigation.” What the additional liti
gation would be was not immediately
apparent
The Governor promised the "sparks

superintendents, whose salary checks
were drawn against the fund im
pounded in the Atlanta banks, would
be paid from other state moneys.
