the Court to direct the administraor of the estate
of Jeremiah Casticbe-rry, deceased, to make titles to
the said John Kedelt, of tot of land number ninety-eight,
•a the twenty-seven-h district, and thud section of ori- j
giually Cherokee, now Walker county, in accordance j
with the condition of the bund of the said Jeremiah
Castleberry, (a copy of which is annexed to said p ti- j
turn,) it appearng to the Court that the said Jeremiah ;
Castleberry, deceased, tii 1, in his lifetime, to wit: on
ne fourteen h day of May, in the year of our Lord |
eighteen hundred and thirty-six, enter in o and make j
his bond, by which he bound himself to make titles to j
die said John Kellett, of and to a certain tract of .anl, j
in said bond men ioned, ,o wit: the tract of land above j
lesignatcd ; and that the said Jeremiah Castleberry j
died without having made or executed said tides as j
•daresaid, and without having made provisions there
for by u ill ; and that the said John Kellett has become :
and is entitled to have the title to said tract of laud, as
aforesaid. These are therefore to notify’ all persons
concerned of the aforesaid application or petition, and
that Simeon Castleberry, administrator of the estate of
said Jeremiah Castleberry, deceased, will be directed
to make titles, agreeable to the condition of said bond,
at the next term of this Court, after the expiration of
three months from the date of this order, proviued no
objection be filed thereto. And it is ordered by the
Court that a copy of the foregoing be published in one
of the public gazttes of this State, at least three
months, and in the public places of Eaxd Court of Tal
bot.

MUSCOGEE SUPERIOR COURT,
November adjourned Term.
‘H'TPON the petition of Hervey Hall, sia ing that he
is the legal assignee and holder of a certain deed
of mortgage, made and executed by Nathan IJ.1 J . Wil
lard, of the county of Muscogee, to Chancey Pomroy
and George Montague, who were the co-pariners un
der the name and firm of Pomroy St Montague, dated ,
the fourth day of August, eighteen hundred and thirty- ‘
five, and made the better to secure the true and full :
payment of a certain promi-sory no r e. made by j
Ephraim Wheelock and said Nathan P. Willard, who !
were then co-pariners under the name and firm of
Wheelock & VViilard ; anl which said note bears even
date with said deed of mortgage, and is payable on or
before the third day of July, eighteen hundred and
thirty-seven, to the said Pomroy and Montague, for
fifteen hundred dollars,for value received, wiih interest
from date ; by which said deed, the said Nathan P.
Willard, mortgaged to the said Pomroy and Montague,
their heirs and assigns, two half acre town lots, situate,
lying and being in the town of Columbus, known and
distinguished in the plan of said town by numbers se
veniy-two and seventy-six, with all their tenements,
members and appurtenances thereto or in any wise
belonging, upon which said lots the tavern of the Co
lumbus Hotel is now situated : And that the said pro
missory note and deed of mortgage is now due, and the
said sum of money therein specified, wholly unpaid,
due and owing now to the said Hervey Hall, as indor
see of said promissory note, and assignee of said deed
of mortgage ; and praying a foreclosure of said deed of
mortgage in terms of the law. It is therefore ordered,
by the Court, that the said Nathan P. Willard the
mortgagee in said deed of mortgage men'ioned. do pay
into the Clerk’s office of the Superior Court of Musco
gee county, the full amount of the principal and inte
rest due upon ihe said promissory note and deed of
mortgage, on or before the first day of the next term of
said Superior Court, with all costs which may have
accrued thereon ; or the equity of redemption of the
said Nathan P. Willard, of. in and to the said mort
gaged premises will he forever barred and foreclosed,
and the same sold according to law. And it is further
ordered, that a copy of this rule be serve on the mort
g igcr, three months before the next term of this Court,
or published in one of the public gazettes for four
tnon'hs before the said next term of this Court.

presents, the receipt whereof is hereby acknowledged,
hath bargained, sold, and conveyed and by these pre
sents doth bargain, sell, and convey unto the said Sea
born B Picket, his heirs and assigns all that half of
lot ofianl, situale, lying and being in the 14 h district
of originally Muscogee, now Ta bot county, know’n
and distinguished in the plan of sai 1 district, by No. 46
it being the half of said lot of land, which lie s north of
the line run through 3aid lot by Thomas T. Riley, on
the O'h day of December, one thousand eight hundred
and thirty-four containing one hundred one and one
fourth acres, m -re or less : To have and to hold the
sail half lot or parcel of land unto lnm the said Seaborn
B. Picket, his heirs and assigns, toget ler with all and
singular the rights, members and appurtenances to the
same belonging to nis and their proper use. benefit, and

KNOW all men by these presents, that I, William [
Oliver, am held anti firmly bound in the penal sum of i
seventeen hundred dollars, un'o Dossey Ivey, of Bald-!
win county, for the pnyment of which, well and truly to ‘
be made. I bind myself my heirs, executors, administra-!
i tors and assigns, jointly and firmly by these presents. I
The conditions of the above obligation is such, that |
the above bound William Oliver of Randolph count}’,
has bargained and sold unto Dossey Ivey, of Baldwin
county, one half section of Land, containing three
hundred and twenty acres, lying and in the State of
Alabama, and county of Barbour, it being the west
halt of section 9, township 11 and range 29. Now if
the said YVilliam Oliver makes or causes to be made
good and lawful titles to the above described Land,
alter the payment is made by the said Ivev, of the sum j
of eight hundred and fifty dollars, then and on that con- j
dition, the above bond to be null aud void, otherwise to ;
remain in full force and virtue in law. as though there j

THE utility of It. S. BERNARD’S Remedy for
Cholera has ceased to be a problem. Experi
ence, the only sure foundation of Medicinal as c f all
other kinds of knowledge, has effectually established
what the judicious composition of the Remedy, its
admirable adaptation to the various indications which
occu. in the course of those diseases of the stomach,
liver and bowels, usually designated as Cholera Com
plaints, led the proprietor to anticipate from the fist. Cf
all experience, however, that of men competent todis
crimina e accurately and to decide justly upon the
effects of a medicine, must be the besi; and with such
in its favor, even tlie most fastidious in these matters
