county, made and delivered to the said Wm. H. his certain
promissory note, bearing date the day and year aforesaid,
wherbythe said William Irvine promised cn the 25th day of

H. or bearer, Two Hundred and Fifty-Eight Dollars, and Sev

twenty-fifth day of December 1851, Johnston Thornton
made and delivered to your petitioner his certain Reed of
Mortgage, bearing date the day and year aforesaid, whereby
said Johnson Thornton, amongotber things, conveyed to your
petitioner the North Xof lot of land No 23, in the Bth Dist.
of originally Momoe, then and now said county of Pike; also
the South X of lot of laud No. five, in the third district, of orig
inally Monroe, then and now said county of Pike, forgthe pur
pose of securing to your petitioner the payment of a promisso
ry note which tha said Johnston Thornton had before that time

Uappearing to the Court, on the affidavit of Robert Beasly,
Sr., by petition in writing now filed in the clerk’s office of this
Court, that Johnston 1 horrton, heretofore to wit, on the 25th
day of December 1851, made and delivered to said Robert
Beaslj, Sen’r , his Deed of Mortgage, bearing date the day
and year aforesaid, whereby said Johnston Thornton conveyed
to said Robert Beasly Sr., among other things, the north half
of lot of land No two hundred and twenty three in the eighth
district of originally Monroe, then and now said county of
Pike, also the South half ol lot of landNo five, in tbe3d dis
trict of originally Monroe, now said county ot Pike, for the bet
ter securing the payment of a promissory note before that i
terra,to wit, on the 6th day of Afarch 1851,madeand delivered to
said Robert Measly sen., by said Johnston Thornton, whereby
said Thoi nton promised by the 251a day of Decemoer 1852, to
pay said Beatty or bearer, the sum ol Two Thousand Dollars

IT appearing to the Court, by the petition of Jacob B. Shrop
shire, that William Taylor, of said county, deceased, did in
his life lime execute to Richard Jacobs his bond conditioned
to execute good and sufficient titles to said Richard Jacobs for
lot of land number forty-five, in the fifth district of originally
Lee, now r Randolph county, —and it further appearing that
9aid William Taylor departed this life witnut executing title
for said land, or in any way providing tturefor, and before the
1 purchase, money for said land was due: and >t further appeiring,
that subsequently to the death of said Wm.Taylor,the said Rich’d
Jacobs,lor value received and by endorsement,transferred the
said bond to one Delaware Morris, and alterward, on a certain
day, in said petition mentioned, the said Delaware Ji/otris, in
like manner transferred the said bond to the said Jacob B Shrop
shire, and it further appearing that the said Jacob B. Shrop
shire has fully paid the amount of the purchase money for said
latui with interest, to Henry L. Taylor, Administrator L de bonis
non on the estate of said William Taylor; and said Jacob
B. Shropshire having petitioned this court to direct the said
Henry L.Taylor, administrator as aforesaid, to execute to him
